Minutes of the Special Meeting the Council of the City
of Bakersfield, California, for the purpose of a Public Hearing
held in the Council Chambers of City Hall, 1501 Truxtun Avenue,
at 5:15 p.m., August 8, 1988.
The meeting was called to order by Mayor Payne.
Present:

Upon a motion by Councilmember Peterson, Council will
deviate from normal procedure, acknowledge and respond to ques-
tions from the public after the hearing is conducted.
Cecilia Johnson, 2327 California Avenue, spoke in oppo-
sition to gate fees.

Richard Iverster, 3001 Parkway, spoke in rebuttal and
stated that the garbage collectors are not picking up the garbage
as scheduled.
Henry Owen McCarthy, 3101 Oakridge Drive, spoke in
rebuttal of gate fees.
No further protests or objections being received, and no
one wishing to speak in favor, Mayor Payne closed the public por-.
tion of the hearing for Council deliberation and action.
Council and Staff answered the public's questions.
Councilmember McDermott made a motion that the Council
reaffirm their opposition to gate fees and ask the County to
change their decision regarding gate fees; if after review by the
County they decide to approve gate fees, Council urges the County
to review their costs and allocate the costs more appropriately
over the life of the landfill and to set a fee for each landfill
separately instead of having one area subsidize the rest of the
areas; Council appropriate the additional revenue in the
amount of $2,000,000.00 to the Refuse Service Budget be co~]tin-
gent upon the County deciding after review to impose gate fees;
continue the Senior Citizen rebate and set the level this year at
60 percent of the cost; and urge Council and Staff, if schedules
permit, to attend the Board of Supervisors meeting on August 15,
1988.
Councilmembers stated their opposition to gate fees.
Mayor Payne requested staff explore mechanisms to inform
senior citizens of the rebate.
Upon a motion by Councilmember Childs, the call for the
question was approved.
The motion by Councilmember McDermott, that the Council
reaffirm their opposition to gate fees and ask the County to
change their decision regarding gate fees; if after review by the
County they decide to approve gate fees, Council urges the County
to review their costs and allocate the costs more appropriately
over the life of the landfill and to set a fee for each landfill

Upon a motion by Councilmember Ratty, the Council's sup-
port of the concept of land use fees to be administered in a fair
and equitable manner was approved by the following vote:
Ayes: Councilmembers Smith, DeMond, Ratty,
Noes: Councilmembers Childs, McDermott
Abstain: None
Absent: None

Salvaggio
ADJOURNMENT
There being no further business to come before the
Council, upon a motion by Councilmember Childs the meeting was
adjourned at 8:05 p.m.
