AN ORDINANCE AMENDING SUBSECTIONS
E AND F AND ADDING SUBSECTION G TO
SECTION 6.04.110 OF THE BAKERSFIELD
MUNICIPAL CODE RELATING TO VICIOUS
OR DANGEROUS ANIMALS.
BE IT ORDAINED by the Council of the City of Bakersfield as follows:
SECTION 1.
Subsections E and F of Section 6.04.110 of the Bakersfield Municipal Code is
hereby amended to read as follows:
6.04.110 Vicious or dangerous animals.
E. Appeals of actions taken by the health officer or his designee pursuant
to this section shall be made in writing to the Vicious and Dangerous Animals
Administrative Review Board, and filed with the City Clerk within five working days of the
impoundment. The appeal shall list the name, address, and phone number of the legal
owner(s) or persons having custody of the animal(s) and shall state the reason(s) for
appeal. The appeal shall be heard within thirty days of its filing by the administrative
review board established in subsection F.
F. There is established a five-member administrative review board known
as the Vicious and Dangerous Animals Administrative Review Board.
1. Members shall be appointed by the full City Council for
staggered two year terms. Initially, in 1998, three members shall be appointed for
three-year terms and two members appointed for two-year terms. Thereafter, all
appointments shall be made for two years. Notwithstanding the term of appointments,
members shall continue to serve until replaced by appointment by the City Council.
2. Whenever practical, the City Council is to appoint at least two
members from veterinary associations and one member from a humane society or animal
control agency other than the one holding the City animal control contract.
3. Members shall serve at the pleasure of the City Council and
may be removed at any time by the affirmative vote of five members of the council.
SECTION 2.
Subsection G is hereby added to Section 6.04.110 of the Bakersfield Municipal
Code to read as follows:
G. All decisions of the Vicious and Dangerous Animal Administrative
Review Board shall be final.
SECTION 3.
This Ordinance shall be posted in accordance with provisions of the Bakersfield
Municipal Code and shall become effective thirty (30) days from and after the date of its
passage.
