The meeting was called to order by Mayor Payne followed by the Pledge of Allegiance. City Clerk Williams called the roll as tollows: Present: Mayor Payne. Absent: None Councilmembers Childs, DeMond, Ratty, Peterson, McDermott, Salvaggio, Smith (seated at 5:20) HEARINGS This is the time set for a public hearing to consider proposed uses of Federal Revenue Sharing Funds for Fiscal Year 1988-89. This hearing has been duly advertised as required by law. Assistant City Manager Strenn provided a brier update. Mayor Payne declared the hearing open for public participation. No protests or objections being received and no one wishing to speak in favor, Mayor Payne closed the public portion of the hearing for Council deliberation and action. Councilmember Childs made a motion to transter $500,000 in Revenue Sharing Funds to the Capital Outlay Fund ($250,000) and the Airpark Fund ($250,000). Councilmember Salvaggio asked start to provide the Council with a memorandum narrative showing figures from the beginning of the purchase of the A~rpark, specitlcally cash flow and operating. City is another Councilmember Salvaggio stated for the record that subsidizing the Airpark from the General Fund from perspective. the Mayor Payne restated Councilmember Childs' motion "to approve transfer ot $500,000 in Revenue Sharing Funds to the Capital Outlay Fund ($250,000) and the Airpark Fund ($250,000). The motion was approved by the tollowing vote: Ayes: Councilmembers Smith, Childs, DeMond, McDermott, Salvagglo Noes: None Absent: None Ratty, Peterson Bakersfield, California, June 13, 1988 - Page 2 This is the time set for a public hearing before the Council ~or hearing protests by property owners on the amount of assessment or the fairness of the benefit formula to be borne by all parcels of property within Maintenance Districts 1 through 17, which provides the bases for the benefit assessments for maintaining certain local improvements within each District. This hearing has been duly advertised and property owners notified as required by law. MAINTENANCE DISTRICT NO. 1: This district includes streetscapes along Gosford Road, Stockdale Highway, Kroll Way, Camino Media, and Ming Avenue. Correspondence has been received trom O. D. Simpson, 8000 Kroll Way, No. 90, dated June 2, 19~; and Mrs. Loraine Baranowlcz, 512 Berwick Street; Mrs. Carol Haddock, 504 Berwick Street, in opposition to Maintenance District No. 1. Councilmember McDermott asked staf~ to review the assessments with regards to parks and prepare a calculation of a city contribution ot 20 percent reviewed and presented as a proposal for the maintenance districts at the Council meeting o~ June 22, 1988. Interim Public Works Manager Schulz provided an update on Maintenance District No. 1. Mayor Payne declared the hearing open for public participation. The ~ollowing individuals spoke in opposition: Ashley Young, 8000 Kroll Way, Granhllda Schwaltz, 8009 Chelsea, Oleda Simpson, 8000, Kroll Way, and Virgina Tempist, 8000 Kroll Way. No further protests or objections being received, and no one wishing to speak in favor, Mayor Payne closed the public portion of the hearing for Council deliberation and action. Councilmember McDermott ask sta~ to try and accomplish a formal mechanism so property owners can have an input on serv- ices being provided, such as an advisory committee to review plans for the year. Adoption of Resolution No. 99-88 of the Council of the City of Bakersfield approving and adopting the 1988-89 Budget, levying assessments, reserving the right to perform maintenance work by City forces and authorizing collection of assessments by the Kern County Tax Collector. Bakersfield, California, June 13, 1988 - Page 3 Upon a motion by Councilmember Peterson, Resolution No. 99-88 of the Council of the City of Bakersfield was adopted by the following vote: Ayes: Noes: Absent: Councilmembers Smith, Childs, DeMond, Ratty, McDermott, $alvaggio None None Peterson Councilmember Salvaggio clarified his vote stating that this was the first time he voted tor a Maintenance District budget without having to get into political battle. This issue has been a very controversial during the last three years. He supported this because he wants to work with his Councilmembers, and he wants to work towards being a productive individual on this issue. Councilmember Peterson clarified his vote stating that this is a hard issue and one that he is not entirely comfortable with. He teeIs staff should continue to look at ways to improve the costs, to keep them down, to be effective and efficient. Councilmember Childs clarified his vote stating that he supports the Maintenance Districts because the City does not have the money to maintain these district. He doesn't feel the resi- dents should have to pay twice. MAINTENANCE DISTRICT NO. 2: This district includes Amberton Park. Correspondence has been received from Mr. James J. Metchiko~f, 6608 Caswell Avenue, dated May 31, 1988; and from S.M. Irwin and E.L. Irwin, 1701 Angels Camp Street, dated June 1988, in opposition to Maintenance District No. 2. 6 t Interim Public Works Manager Schulz provided an update on Maintenance District No. 2. Councilmember Peterson stated that the maintenance of parks is a City service and should be provided by the City. He wants to see that the maintenance districts that are supporting parks be put back into some kind ot fund so there is not a double tax situation. Councilmember Peterson made a motion to adopt Resolution No. 100-88 of the Council of the City of Bakerstield and to appropriate $105,000 to help reduce all the maintenance districts' costs within the city that support a park by a rate of 20 percent across the board. Bakersfield, California, June 13, 1988 - Page 4 City Manager Hawley recommended that in-lieu monies be utilized from the Community Services, Water Division, or to reduce new employee requests to appropriate funds for maintenance districts. Councilmember Peterson agreed to incorporate the utili- zation o£ in-lieu monies from the Community Services, Water Division to his motion. Councilmember Peterson clarified his motion stating that this would apply to the park sections ot the maintenance districts. Mayor Payne restated Councilmember Peterson's motion "to adopt the Resolution approving the budget, levying assessments, reserving the right to pertorm maintenance work by C~ty ~orces and authorizing collection o~ assessments by the Kern County Tax Collector, with the inclusion of the appropriation o~ $105,000 to help reduce the assessments by 20% across the board for all maintenance district with parks, with the 20% being restricted to the park portion." Upon the request of Councilmember Childs, Councilmember Peterson separated his motion into two motions. Correspondence has been received from Sharon Dolan and Robert Warawa, 8408 Stuart Court, dated June 1, 1988; Robert L. Stempies, 8220 Sargent Way; and Wm. B. Mandeville, 4713 Ganter Court, in opposition to Maintenance District No. 3. Interim Public Works Manager Schulz provided an update on Maintenance District No. 3. Mayor Payne declared the hearing open for public participation. Sheri HeLtern, 8205 Bellows, thanked Frank Fabbri ~or the time he took to explain the assessment for maintenance districts, and she spoke in opposition to maintenance districts. Carson Blacklock, 9104 Gleason Court, spoke in opposi- tion of the double charges. Mike Moore, 9012 Ferber Lane, spoke in opposition. Robert Stempies, 8220 Sergeant Way, spoke in opposition. Merilyn McIndo, Real Estate Agent, stated that they were not given disclosure based on the assessment.
