A RESOLUTION DETERMINING THAT WORK FOR DEVELOPMENT OF AN ENGINEERING PLAN AND REMOVAL OF SOIL FROM THE FORMER PANORAMA BURN DUMP CANNOT BE REASONABLY OBTAINED THROUGH USUAL BIDDING PROCEDURES AND AUTHORIZING THE FINANCE DIRECTOR TO DISPENSE WITH BIDDING THEREFOR. WHEREAS, under Agreement No. 96-52 with Kleinfelder, Inc. and Amendments No. 1 and 2 to said Agreement, City has obtained a Remedial Action Plan (RAP) for the former Panorama Burn Dump; and WHEREAS, said Remedial Action Plan was required by and has been accepted by the California Department of Toxic Substances Control (DTSC); and WHEREAS, an Engineering Plan is required to be filed with DT$C prior to understanding work to implement the Remedial Action Plan; and WHEREAS, Kleinfelder, Inc. is best suited to prepare said Engineering Plan and to implement said Remedial Action Plan due to familiarity with the project from work done to date; and WHEREAS, mitigation of the burn dump will be achieved in the most expedient foreseeable manner using services from Kleinfelder, Inc. because of time saved ~in preparing said Engineering Plan and bid specifications, and in selecting various subcontractors for remediation work; and WHEREAS, the Public Works Director recommends the Council find that said 'work, supplies, equipment and materials cannot be reasonably obtained from more than one vendor because of the need to successfully integrate such work, supplies, equipment and materials into the existing project and recommends this Council authorize the Finance Director to dispense with bidding; and WHEREAS, the Finance Director recommends the Council find said project's work, supplies, equipment and materials cannot be reasonably obtained from more than one vendor as per the Public Works Director recommendation and recommends the Council dispense with bidding under subsection D. 1. of Section 3.20.060 of the Bakersfield Municipal Code. NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Bakersfield as follows: reference. The above-recitals are true and correct and incorporated herein by Page 1 of 2 Pages ORIGINAL 2. The work, supplies, equipment and materials cannot be reasonably obtained from more than one vendor because of the need to successfully integrate the work, supplies, equipment and materials into an existing City project. 3. The Finance Director is authorized to dispense with bidding in accordance with subsection D.I. of Section 3.20.060 of the Bakersfield Municipal Code. 4. The Mayor is authorized to execute Amendment No. 3 to Agreement No. 96-52, as approved by City staff, with Kleinfelder Company. 5. The expenditure of funds for said work, supplies, equipment and materials involved with said amendment shall not exceed $380,000.
