TOTAL PAID Star Types:l A RESOLUTION ORDERING THE VACATION OF 14TH STREET FROM "N" STREET TO "P" STREET, "O" STREET FROM SOUTH OF 14TH STREET TO THE BURLINGTON NORTHERN SANTA FE RAILWAY AND THE ALLEYS IN BLOCKS 348, 349 AND 370 IN THE CITY OF BAKERSFIELD. WHEREAS, on WEDNESDAY, SEPTEMBER 24, 1997, the Council of the City of Bakersfield, pursuant to the provisions of the "Public Streets, Highways and Service Easements Vacation Law," being Chapter 3 of Part 3 of Division 9 of the Streets and Highways Code of the State of California, passed and adopted its Resolution of Intention No. 1164 declaring its intention to order the vacation of 14th Street from "N" Street to "P" Street, "O" Street from south of 14th Street to the Burlington Santa Fe Railway and the alleys in Blocks 348, 349 and 370 in the City of Bakersfield; and WHEREAS, for the above-described project, it was determined that the proposed vacation is exempt from CEQA according to Section IV.B3(f) of City of Bakersfield CEQA Implementation Procedures, pursuant to Section 15305 of CEQA Guidelines (Class 5) in that there is no possibility that the street and alley fight of way vacation and proposed use could have a significant effect on the environment; and WHEREAS, at its meeting on September 4, 1997, the vacation was duly heard and considered by the Planning Commission and was found to be consistent with the Metropolitan Bakersfield General Plan; and WHEREAS, said Council did fix a time and place for hearing all persons interested in or objecting to said proposed vacation, which hearing was held on Wednesday, October 22, 1997, after notices were duly published and posted as required by law. -1- NOW, THEREFORE BE IT RESOLVED by the Council of the City of Bakersfield as follows: 1. The above recitals are true and correct and are incorporated herein. All of the 82.5 foot wide public street right of way for 14th Street bounded westerly by the east right of way line of "N" Street and bounded easterly by the west right of way line of "P" Street; all of the 82.5 foot wide public street right of way for "0" Street bounded northerly by the south right of way line of 15th Street and bounded southerly by a line parallel to and 60 feet south of the south right of way line of 14th Street; all of the 33 foot wide public alley in Block 348 bounded by the east and west line of said block; All of the 33 foot wide public alley in Block 349 bounded by the east and west line of said block; and all of the 20 foot wide alley (diminished width) in Block 370 bounded by the east and west lines of said block, as said streets, alleys and blocks area shown on "Map of the City of Bakersfield" filed for record November 25, 1898 in the office of the Kern County Recorder, is unnecessary for present or prospective use for public street or alley purposes and is hereby vacated, subject to the conditions enumerated herein. A non-exclusive easement shall be reserved for public utilities purposes in, under, over and upon the entire above described street and alley right of way area. Full access for utilities shall be maintained to the greatest extent possible. A non-exclusive vehicular trail for ingress and egress purposes shall be reserved over and upon the east 107 feet of the above described alley in Block 370 for use by the present owner of lot at 1311 "O" Street, being Kern County Assessor's APN 006-471-02. This trail reservation shall terminate and the trail shall automatically be abandoned upon sale or transfer of said lot (1311 "O" Street) by the present owner. The City Clerk shall certify to the passage of this Resolution and shall cause a certified copy hereof, attested by the Clerk under the seal of the City, to be recorded in the Office of the County Recorder of the County of Kern, California. ...... o0o ......
