A RESOLUTION ADOPTING A RECYLED
PRODUCTS PROCUREMENT POLICY.
WHEREAS, it is the policy of the City of Bakersfield to conserve and protect natural
resources for current and future citizens; and
WHEREAS, sanitary landfill capacity is an increasingly scarce resource in California
and throughout the nation and must be preserved; and
WHEREAS, much of the materials entering the waste stream can be recycled,
reused or incorporated into manufacturing new products; and
WHEREAS, City participation in, and promotion of, recycling and other waste
diversion and reduction strategies conserves valuable resources, is the sustainable way to
conduct business, and significantly reduces the volume of material disposed at a landfill,
thereby extending its life and minimizing disposal costs; and
WHEREAS, the development of markets for recyclable materials is essential to
effective waste diversion programs and in order to develop that market, it is necessary to
make available products which contain recycled materials or which are reusable or
recyclable; and
WHEREAS, the enactment of a recycled product procurement policy is intended to
broaden the use of recycled content products; and
WHEREAS, the City's commitment to the purchase of recycled materials and
products will foster market development for recycled products and serve as a model for
private industries and local businesses; and
WHEREAS, the recycled product procurement policy will put the City "on record" in
support of progressive procurement and market development goals; and

WHEREAS, State and Federal agencies have implemented procurement guidelines

WHEREAS, the California Integrated Waste Management Act of 1989 (AS 939)
mandates that cities reduce solid waste and that they participate in and promote recycling
programs; and
WHEREAS, a recycled product procurement policy will further contribute to the
City's compliance with State requirements that cities reduce solid waste and that they
participate in and promote recycling programs; and
WHEREAS, it is in the public interest to formalize recycled procurement practices
within the City organization and provide additional guidance to City departments regarding
the procurement of recycled products.
NOW, THEREFORE, BE IT RESOLVED, by the Council ofthe City of Bakersfield as
follows:
1. The above recitals are true and correct and incorporated by reference herein,
2. The City of Bakersfield's Recycled Products Procurement Policy, attached
hereto as Exhibit "A," and incorporated herein by reference, is hereby approved.

RECYCLED PRODUCTS PROCUREMENT POLICY

To promote the use of recycled products and recyclable products by City departments.
Policv
It is the policy of the City of Bakersfield to utilize recycled products and recyclable
products when feasible, thereby diverting materials from the solid waste stream.
Emphasis shall be placed on the purchase of products manufactured with post-
consumer recycled material.
General Reauirements
The Recycled Products Procurement Policy directs each City department to evaluate its
opportunities for the use of recycled products and recyclable products whenever
feasible. The City shall promote the use of recycled and recyclable products by
publicizing its procurement policy whenever practical.
Benefits of Buying Recycled Products. Buying recycled products benefits the City in
the following ways:
a. The recycling of waste materials into new products reduces the resources
disposed of in landfills.
b. Buying recycled products conserves resources by reducing our dependence on
virgin raw materials, the cost of which will continue to climb as sources are
depleted.
c. The growth in recycling results in the creation of jobs and economic development
opportunities.
d. Buying recycled provides a proactive, rather than reactive, approach to our waste
management.
e. Enhancement of the City's image as a result of environmental stewardship and
leader in Green Business practices.
f. Many recycled products are competitively priced or less expensive than their
non-recycled counterparts.

Recycled Content Preference. Whenever feasible, the City shall purchase products
which contain, in order of preference, the highest percentage of:
a. Post-consumer recovered materials available in the market place
b. Pre-consumer recovered materials available in the market place
Recyclability and Waste Reduction. In addition to the recovered material content of
the product, important criteria in selecting products shall also be:
a. The ability of a product and its packaging to be reused, reconditioned for use or
recycled through existing recycling collections programs; and
b. The volume and toxicity of waste and by-products that a given product and its
packaging generate in their manufacture, use and recycling and disposal.
Products and packaging designed to minimize waste and toxic by-products in
their manufacture, use, recycling and disposal shall be preferred.
Equipment Compatibility. Equipment purchased or rented by the City, such as
photocopiers and plotters, shall be compatible, whenever feasible, with the use of
recycled-content and source reduction products.
Paper and Paper Products. Paper purchased for printing and writing should contain at
least 30% post-consumer material, if that paper is available at a cost equal to paper
made of virgin material and meets the quality, specifications and functionality of the
virgin material paper. Whenever practical, recycled paper products such as letterhead,
envelopes or business cards, shall contain the Recycled symbol or the words "Printed
on recycled paper". To the extent feasible, City departments will utilize two-sided
copies for memos, reports, mailings, etc.
The City shall endeavor to purchase or lease copiers and printers, and other such
equipment, capable of using recycled paper of the appropriate grade.
Resøonsibilities of the Purchasina Division
The Purchasing Division shall:
a. Keep departments informed regarding recycled product procurement
opportunities.
b. Work with departments on establishing minimum recycled content standards for
designated recycled products to maximize recycled product availability, recycled
content and competition.
c. Educate suppliers and contractors on issues relevant to source reduction and
recycled products whenever necessary and appropriate.

Exemøtions to Recvcled Product Procurement
a. Nothing contained in this policy shall preclude user departments from specifying
"recycled" material content as a bid specification.
b. Nothing in this policy shall be construed as requiring a department to procure
products that do not perform adequately for their intended use or are not
available at a reasonable price in a reasonable period of time.
c. Nothing in this policy shall be construed as requiring a department to procure
products where the warranty for recycled products is not equal to virgin products
or where the recycled material voids, shortens, interrupts or cancels warranty
of other supplies or units of components.
Definitions
Feasible. Sufficient in quality, fitness and performance; available at a cost no greater
than non-recycled products price; and, available within a reasonable time period.
Practical and fiscally responsible, not comprising overall budgetary or performance
requirements.
Post-Consumer Recycled (Recovered) Materials. A finished material or product that
has served its intended use and has been discarded for disposal or recovery by a final
consumer. Examples of post-consumer recovered materials include, but are not limited
to, used newspaper, office paper, yard waste, plastic bottles, aluminum cans, steel, oil,
asphalt, concrete and tires.
Pre-Consumer Recycled (Recovered) Materials. Material or by-products generated
after manufacturing of a product is completed, but before the product reaches the end-
consumer. Examples of pre-consumer recovered materials include, but are not limited
to, obsolete inventories of finished goods, rejected unused stock, and paper wastes
generated during printing, cutting and other converting operations.
Recovered Material. Fragments of products or finished of a manufacturing process,
which has converted a resource into a commodity of real economic value, and includes
pre-consumer and post-consumer material but does not include excess resources of the
manufacturing process,
Recycled Content. The percentage of recovered material, including pre-consumer and
post-consumer materials, in a product.
Recycled Material. Waste material and by-products that have been recovered or
diverted from solid waste and that can be utilized in place of raw or virgin material in
manufacturing a product. Recycled material may consist of materials derived from post-
consumer waste, manufacturing waste, industrial scrap, agricultural wastes and other
items, all of which can be used in the manufacture of new products.

Recycled Product. A product which, after its intended end use, is reusable or
refillable, or can demonstrably be diverted from the solid waste stream for use as raw
material in the manufacture of another product.
Recycled Product Preference. To provide for the purchase of products by the City
that, price and quality being equal, preference shall be given to recycled products or
suppliers utilizing them.
Remanufactured Product. A product diverted from the supply of discarded materials
by refurbishing and marketing the product without substantial change to its original form.
Reused Product. A product designed to be used many times for the same or other
purposes without additional processing except for specific requirements such as
cleaning, painting or minor repairs.
Source Reduction Product. A product that results in a net reduction in the generation
of waste compared to the previous or alternate version and includes durable, reusable
and remanufactured products; products with no, or reduced, toxic constituents; and,
products marketed with no, or reduced, packaging.
Total Recovered Material. The total pre- and post-consumer recovered material
contained in a product.
