RESOLUTION OF INTENTION NO. 1424
CITY OF BAKERSFIELD
ASSESSMENT DISTRICT NO, 05-2
(MONTAIREIPALADINO HILLS)
WHEREAS, under the authority of the Municipal Improvement Act of 1913
(Sections 10000 and following, California Streets and Highways Code), this Council intends to
order the acquisition and/or construction of the improvements described in Exhibit A, attached
hereto and by this reference incorporated herein, all of which are situated within the City of
Bakersfield Assessment District No. 05-2 (Montaire/Paladino Hills), County of Kern, State of
California (the "Proposed Assessment District"); and
WHEREAS, this Council finds that the land specially benefited by the
improvement is a portion of the land shown within the boundaries shown on the Boundary Map
previously approved by resolution of this Council, said benefited portion of the land being shown
thereon by a shaded tone. The land within the exterior boundaries shown on the map shall be
designated the "City of Bakersfield Assessment District No. 05-2 (MontairelPaladino Hills),
County of Kern, State of California."
NOW, THEREFORE, THE CITY COUNCIL HEREBY FINDS, DETERMINES
AND RESOLVES as follows:
1. This Council intends to levy a special assessment upon designated portions
of the land within the Proposed Assessment District in accordance with the special benefit to be
received by each parcel of land, respectively, from the improvement.
2. Where any disparity occurs in level or size between the improvement and
private property, this Council determines that it is in the public interest and more economical to

eliminate the disparity by doing work on the private property instead of adjusting the work on
public property. Accordingly, work may be done on private property for this purpose with the
written consent of the landowner,
3. This City Council intends, pursuant to subparagraph (f) of Section 10204
of the California Streets and Highways Code, to provide for an annual assessment upon each of
the parcels of land in the Proposed Assessment District to pay various costs and expenses
incurred nom time to time by the City and not otherwise reimbursed to the City which result
from the administration and collection of assessment installments or nom the administration or
registration of the improvement bonds and the various funds and accounts pertaining thereto,
4. Bonds representing unpaid assessments, and bearing interest at a rate not
to exceed twelve percent (12%) per annum, will be issued in the manner provided by the
Improvement Bond Act of 1915 (Division 10, Streets and Highways Code), and the last
installment of the bonds shall mature not to exceed twenty-four (24) years nom the second day of
September next succeeding twelve (12) months nom their date.
5. The procedure for the collection of assessments and advance retirement of
bonds under the Improvement Bond Act of 1915 shall be as provided in Part 1l.1, Division 10,
of the Streets and Highways Code of the State of California,
6. The City will not obligate itself to advance available funds from the City
treasury to cure any deficiency which may occur in the bond redemption fund. A determination
not to obligate itself shall not prevent the City nom, in its sole discretion, so advancing funds,
7. This Council appoints the Director of Public Works of the City as
Engineer of Work for this project, and directs the preparation ofthe report containing the matters
required by Section 10204 of the Streets and Highways Code, as supplemented by Section 4 of

8, In the opinion of this Council, the public interest will not be served by
allowing owners of assessable lands to enter into a contract for the work of improvement as
otherwise permitted in Section 20485 of the Public Contract Code.
9. The amount of any surplus remaining in the improvement fund after
completion of the improvement and payment of all claims shall be distributed in accordance with
the provisions of Section 10427,1 of the Streets and Highways Code.

DESCRIPTION OF IMPROVEMENTS
ASSESSMENT DISTRICT NO. 05-2
(MONT AIRE / PALADINO HILLS)
The Assessment District No. 05-2 ("AD 05-2") Improvements include the construction
and installation as separate systems of certain City of Bakersfield ("City") owned
infrastructure improvements, or certain utility system improvements to be owned and
operated by regulated public utility companies, the payment of certain City facilities
capacity charges, plan check and inspection fees, appurtenances and incidental work in
connection therewith, which are generally described as follows:
Montaire Area (Tract No. 6137)
MASTERSON STREET IMPROVEMENTS
Construction of the east half of Masterson Street along the western frontage of Tract No.
6137 (from Paladino Drive northerly to the Grand Canyon Drive intersection) and of the
entire street within Tract No. 6137 (from the Grand Canyon Drive intersection
northeasterly to the Tract No. 6137 northern boundary), including grading and erosion
control with S-inch thick canyon subdrain, terrace drain and slope brow ditch, paving
with subgrade preparation, 6-inch curb with gutter, median curb, 6-foot wide sidewalk,
street signs, pavement striping, street lights with conduit and pull boxes, joint utility
trenching, 12-inch diameter sanitary sewer pipeline with manholes and connection to
existing sewer main, 6-inch diameter sanitary sewer force main, IS-, 24-, 30-, and 60-
inch diameter storm drain pipeline with catch basins, manholes, and two pipeline outlet
headwalls with rip rap.
PALADINO DRIVE (NORTH HALF) IMPROVEMENTS
Construction of the north half of Paladino Drive along the southern frontage of Tract No.
6137, including grading and erosion control with S-inch thick canyon subdrain and
bench/terrace drain, paving with subgrade preparation, 6-inch curb with gutter, 6-foot
wide sidewalk, handicap ramps, street signs, pavement striping, street lights with conduit
and pull boxes, joint utility trenching, 12-inch diameter sanitary sewer pipeline with
manholes and connection to existing sewer main, S-, IS-, 24-, 30-, 48-, and 60-inch
diameter stonn drain pipeline with catch basins, manholes, four pipeline outlet headwalls
with rip rap, and drainage swale.
PALADINO DRIVE (SOUTH HALF) IMPROVEMENTS
Construction of the south half of Paladino Drive along the southern frontage of Tract No.
6137 (from Masterson Street easterly to the Grand Canyon Drive intersection), including
grading and erosion control with S-inch thick canyon subdrain and bench/terrace drain,
paving with sub grade preparation, 6-inch curb with gutter, 6- foot wide sidewalk,
handicap ramps, street signs, pavement striping, street lights with conduit and pull boxes,
joint utility trenching, 12-inch diameter sanitary sewer pipeline with manholes and

GRAND CANYON DRIVE (ENTIRE STREET) IMPROVEMENTS
Construction of Grand Canyon Drive (the entire street) within Tract No. 6137 (from
Paladino Drive northerly and westerly to Masterson Street), including grading and
erosion control, paving with subgrade preparation, 6-inch curb with gutter, 6-foot wide
sidewalk, handicap ramps, street signs, pavement striping, street lights with conduit and
pull boxes, joint utility trenching, 8-inch diameter sanitary sewer pipeline with manholes
and connection to existing sewer main, 18- and 24-inch diameter stonn drain pipeline
with catch basins, manholes, and two pipeline outlet headwalls with rip rap.
Montaire Area (Tract No. 6465)
ALFRED HARRELL HIGHWAY (SOUTH HALF) IMPROVEMENTS
Construction of the south half of Alfred Harrell Highway along the northern frontage of
Tract No. 6465, including grading and erosion control, existing street cleaning with
debris removal and winterization, paving with sub grade preparation, handicap ramps,
street signs, pavement striping, 12-inch diameter sanitary sewer pipeline with manholes
and connection to existing sewer main, and drainage swale with two reinforced concrete
box drain inlets,
MASTERSON STREET (ENTIRE STREET) IMPROVEMENTS
Construction of Masterson Street (entire street) within Tract No. 6465 (from the southern
boundary of Tract No, 6465 northeasterly to the Tract No, 6465 northern boundary at the
existing Alfred Harrell Highway intersection), including grading and erosion control, 6-
inch curb with gutter, median curb, 6-foot wide sidewalk, street signs, pavement striping,
street lights with conduit and pull boxes, joint utility trenching, and 8-inch diameter
sanitary sewer pipeline with manholes.
Paladino Hills Area (Tract No. 6638)
PALADINO DRIVE IMPROVEMENTS
Construction of the south half of Paladino Drive along the northern frontage of Tract No.
6638 and of the north half of the street from the Alfred Harrell Highway intersection
westerly to the Tract No. 6137 eastern boundary, including grading and erosion control
with 8-inch thick canyon subdrain and bench/terrace drain, paving with subgrade
preparation, 6-inch curb with gutter, 4-foot wide sidewalk, handicap ramps, street signs,
pavement striping, street lights with conduit and pull boxes, joint utility trenching, 12-
inch diameter sanitary sewer pipeline with manholes and connection to existing sewer
main, 8-, 18-, 24-, 48-, and 54-inch diameter stonn drain pipeline with catch basins,
manholes, and drainage swale with outlet rip rap,

ALFRED HARRELL HIGHWAY (WEST HALF) IMPROVEMENTS
Construction of the west half of Alfred Harrell Highway along the eastern boundary of
Tract No. 6638 (from Paladino Drive southerly to the Tract No. 6638 southern boundary),
including grading and erosion control, paving with subgrade preparation, street signs,
striping and monuments.
GRAND CANYON DRIVE (EAST HALF) IMPROVEMENTS
Construction of the east half of Grand Canyon Drive along the western boundary of Tract
No. 6638 (from Paladino Drive southerly to the Tract No. 6638 southern boundary),
including grading with erosion control, paving with subgrade preparation, 4-foot wide
sidewalk, handicap ramps, street signs, pavement striping, street lights with conduit and
pull boxes, and joint utility trenching and monuments.
6O-INCH DIAMETER STORM DRAIN AND BASIN
Construction of 60-inch diameter storm drain pipeline with manholes and tie-in to
existing headwall at the Alfred Harrell Highway on the eastern boundary of Tract No.
6638, and a new storm water disposal basin within Tract No. 6638 with inlet/outlet
structure, headwall, energy dissipater, 38- and 48-inch diameter inlet pipelines with
manholes and catch basins, junction box and transition, basin perimeter fencing and
appurtenances.
RELOCATION OF EXISTING OVERHEAD ELECTRIC TRANSMISSION LINE
The relocation of an existing overhead electric transmission line owned and operated by a
private utility from an existing easement running diagonally across Tract No. 6638 (from
the vicinity of the Paladino Drive and Alfred Harrell Highway intersection near the
northeast comer of Tract No, 6638, southwesterly across Tract No. 6638 to the vicinity of
Grand Canyon Drive at the southwest corner of Tract No. 6638), to a new location within
the right-of-way for Paladino Drive along the northern boundary of Tract No, 6638 and
within the right-of-way for Grand Canyon Drive along the western boundary of Tract No.
6638.
