HomeMy WebLinkAboutRES NO 60-85RESOLUTION NO. 60-85 A RESOLUTION OF THE COUNCIL OF THE CITY OF BAKERSFIELD INITIATING PROCEEDINGS FOR THE ANNEXATION OF TERRITORY TO THE CITY OF BAKERSFIELD IDENTIFIED AS PROCEEDING NO. 865, ANNEXATION NO. 295, IN ACCORDANCE WITH LAFCO RESOLUTION MAKING DETERMINATION (CALIFORNIA AVENUE NO. 5). WHEREAS, a proposal was submitted to the Local Agency Formation Commission of Kern County ("Commission") for the annex- ation of territory to the City of Bakersfield designated as Annexation No. 295 (CALIFORNIA AVENUE No. 5); and WHEREAS, a duly noticed public hearing upon said pro- posal was held before the Commission on the 26th day of March, 1985, and contined to the 9th day of April, 1985; and WHEREAS, following said public hearing the Commission, on April 9, 1985, adopted its Resolution Making Determination, being Resolution No. 85-13, recorded in Minute Book 31 of said Commission. NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Bakersfield as follows: 1. Preliminary proceedings for annexation of territory to the City of Bakersfield designated as Annexation No. 295 (CALIFORNIA AVENUE NO. 5) were authorized by the City Council of the city of Bakersfield by action at a regular meeting thereof held on December 5, 1984; Application for Annexation dated December 5, 1984, was transmitted to LAFCO; the Certificate of Filing of the Executive Officer of the Commission shows that the proposal was filed by him on the 7th day of March, 1985. 2. The distinctive short form designation assigned by the Commission to the territory proposed to be annexed is: "City of Bakersfield Annexation No. 295 (CALIFORNIA AVENUE NO. 5)." 3. The description of the exterior boundaries of the territory proposed to be annexed is contained in Exhibit "A", attached hereto, and incorporated in this Resolution as though fully set forth herein. 4. The territory proposed to be annexed is uninhabited as determined by the Commission in its Resolution Making Determination. 5. The reasons for the proposed annexation as set forth in the proposal thereof submitted to the Commission are that the owners of the affected territory desire to receive, and in some instances already are receiving, municipal services from the City of Bakersfield and the City desires to receive tax revenues for benefits given and to be given to the territory proposed to be annexed. 6. BE IT FURTHER RESOLVED, that Wednesday, the 22nd day of May, 1985, at the hour of 7 p.m. (or as soon thereafter as the matter may be heard) in the Council Chambers of the City Hall, 1501 Truxtun Avenue, Bakersfield, California, is hereby fixed as the time, date and place of hearing on the proposed annexation where any owner of land within, or any registered voter residing within, the said described territory may appear before the Council of the City of Bakersfield and show cause why ~uch territory should not be anneKed. Any owner of land within, or any registered voter residing within, the described territory may file a written protest against the annexation with the City Clerk of the City of Bakersfield at 1501 Truxtun Avenue at any time prior to the conclusion of the hearing on the proposed annexation. 7. That the Negative Declaration as to this project having previously been approved by LAFCO (the lead agency) is hereby adopted and approved by the City of Bakersfield. The pro- ject will not have a significant effect on the environment. 8. The land and improvements within the territory to be annexed shall be liable for the general indebtedness of the City existing at the time of annexation. 9. A certified copy of this Resolution shall forthwith be transmitted to the Executive Director of LAFCO. .......... o0o .......... ANNEXATION NO. 295 CALIFORNIA AVENUE NO. 5 A parcel of land situated in the County of Kern, State of California, being a portion of Section 52) Township 29 South, Raage 28 East, N.D.B. ~ M., more particularly described as follows: Beginning at the intersection of the east line of the west S9.26 feet. of the east half of said Section 32 with the south lime of the north 179.7S feet of the east half of said Section 32, said intersection being a point on the east right-of-way line of South ling Street and also a point on the exi§ting Corporate Boundary of the City of Bakersfield: Thence (1) Westerly along the last named south line ~ the south line of the north 179.7S feet of the west half of said Section $2 to inter- sect the west line of the east 166.18 feet of the west half of said Section 32, said intersection being a point on the eamt right-of-way line of Frago Street; Thence (2) Northerly along the last named west line ~o intersect the south line of the north 57.75 feet of the. west half ~f said Section 52, said intersection being a point on the Existing C~rporate Boundary of the City of Bakersfield; Thence (3) Easterly and southerly along the last name~ Corporate Boundary to the Point of Beginning.
