HomeMy WebLinkAboutRES NO 50-85RESOLUTION NO. 50-85 A RESOLUTION OF THE COUNCIL OF THE CITY OF BAKERSFIELD MAKING FINDINGS, ADOPTING NEGATIVE DECLARATION AND APPROVING SEGMENT III OF PRO- POSED AMENDMENT TO THE LAND USE ELEMENT OF THE BAKERSFIELD METROPOLITAN AREA GENERAL PLAN (LAND USE AMENDMENT 1-85). WHEREAS, the Council of the city of Bakersfield referred Segment III of a proposed amendment to the Land Use Element of the Bakersfield Metropolitan Area General Plan to the Planning Commission; and WHEREAS, the Planning Commission of the City of Bakersfield, in accordance with the provisions of Section 65351 of the Government code, held a public hearing on March 21, 1985, on Segment I[I of a proposed amendment to the Land Use Element of the General Plan, notice of the time and place of hearing having been given at least ten (10) calendar days before said hearing by publication in the Bakersfield Californian, a local newspaper of general circulation; and WHEREAS, such Segment III of the proposed amendment to the Land Use Element of the Bakersfield Metropolitan Area General Plan is as follows: SEGMENT III: AMERICAN SAVINGS AN[) LOAN has applied to change the Low Density Residential (0.5 to 5.49 dwelling units per gross acre) designation for 90.5 + acres to Industrial for property located south of-- Pacheco Road to Harris Road, west of Freeway 99 to Wible Road. WHEREAS, for the above-described Segment, an Initial Study was conducted, and it ~¢as determined that, with mitigation measures incorporated as conditions in the project and accepted by the applicant, the proposed project would not have a signifi- cant effect on the environment, and a Negative Declaration was prepared; and WHEREAS, the law and regulations relating to the prepa- ration and adoption of Negative Declarations as set forth in CEQA and City of Bakersfield Resolution No. 132-83 have been duly fol- lowed by the City Staff and the Planning Commission; and W~EREAS, by Resolution No. 37-85 on March 21, 1985, the Planning Commission recommended approval and adoption of Segment III by this Council and this Council has fully considered the findings made by the Planning Commission as set forth in that Resolution; and W~EREAS, the Council of the City of Bakersfield, in accordance with the provisions of Section 65355 of the Government Code, conducted and held a public hearing on April 10, 1985, on the above-described Segment III of the proposed amendment to the Land Use Element of the Bakersfield Metropolitan Area General Plan, notice of time and place of the hearing having been given at least ten (10) calendar days in the Bakersfield Californian, circulation. before the hearing by publication a local newspaper of general NOW, THEREFORE, BE IT RESOLVED and found by the Council of the City of Bakersfield as follows: 1. The above recitals and findings, incorporated herein, are true and correct. 2. The Negative Declaration for Segment III is hereby approved and adopted. 3. The report of the Planning Commission, including maps and all reports and pap~rs relevant thereto, transmitted by the Secretary of the Planning Commission to the City Council, is hereby received, accepted and approved. 4. The City Council hereby approves and adopts Segment III of the proposed amendment to the Land Use Element of the Bakersfield Metropolitan Area General Plan, subject to the following sixteen (16) conditions incorporated in the project description and agreed upon by the applicant: (1 (2 (3 (4 (5 (6 (7 (8 (9 (10 Development of the project area must conform sub- stantially to plans submitted. The developer shall provide a twenty (20) foot wide landscape berm with sidewalk along the east side of Wible Road, the south side of Pacheco Road, and the north side of Harris Road, outside of the road right-of-way as shown on the proposed plan. The developer shall provide a ten (10) foot wide landscape strip outside of the road right-of-way along all interior streets as shown on the pro- posed plan. The developer shall provide a six (6) foot tall solid masonry wall along the north side of Harris Road, behind proposed landscaping, along the south side of Parcel 6, 7, and 12, and along the south property line of Parcel 13 to mitigate visual impacts for future residential uses south of the project area. If the area to the south is not deve- loped with residential uses, this condition will not apbly. The developer shall provide a six (6) foot tall masonry wall with landscaping along the west side of Wible Road, north of Harris Road, adjacent to exist- ing C-1 (Limited-Commercial) and R-S (Residential Suburban) Zoning and the West Branch of the Kern Island Canal (a distance of approximately 1,300 feet). All lighting shall be directed away from residential areas and Highway 99. All exterior communication shall be designed and placed so as to be inaudible from residential areas. Uses on Parcels 1 through 6 shall be limited to automobile dealerships, offices, or related uses. Pacheco Road, south of the north line of Section 24, Township 30 south, Range 27 east, shall be graded to full width and sufficient paving for one east- bound lane, one westbound lane and a westbound to southbound left turn lane shall be constructed. All landscape maintenance shall be the responsibil- ity of the property owners through a maintenance district. (11) The developer shall either: Acquire the portion of property known as the De-Rancho-Y Mobile Villa located at 6201 Wible Road which is within the typical road right-of- way for Wible Road (a major arterial) and convey said property to the City of Bakersfield for the purposes of widening Wible Road or Be Post a surety bond with the City of Bakersfield for the amount of $250,000 for the purpose of acquiring the above described property and relo- cating affected residents within said property. (12) Dedicate an additional twenty-five (25) foot right- of-way along the east side of Wible Road, between Pacheco Road and the north line of Tract No. 4060. (13) A neighborhood shopping center will not be allowed within the project area. (14) The developer shall provide curb, gutter, and paving to an arterial standard on the west half of Wible Road between Pacheco Road and Panama Lane, excepting those portions which are presently constructed to that standard. Developer shall also provide side- walk on said west half of Wible Road adjacent to Tract No. 3589 and adjacent to De-Rancho-Y Mobile Villa located at 6201 Wible Road. (15) Developer shall provide pavement for two northbound travel lanes on the east one-half of Wible Road bet- ween Harris Road and the north line of Tract No. 4060. (16) The above required improvements will become condi- tions of any subdivision of land or development of any part within the project area. 5. Satisfaction of the conditions set forth above shall be accepted by the City as full satisfaction of the contemplated Site Plan Review Policy for Local Off-Site Improvements as to all structures for which building permits have been issued within three (3) years of the date of this Resolution. 6.
