RESOLUTION OF TILE! COUNCIL OF THE CITY OF
BAKERSFIELD AUTttORIZING FILING OF A VERI-
FICATION THAT SUFFICIENT FUNUS ARE AVAIL-
ABLE AND THAT ALL OTHER MATTERS PREREQUISITE
TO AWARD1NG THE CONTRACT FOR WIDENING AND
REPAIRING THE OAK STREET OVERHEAD AT THE
ATCHISON, TOPEKA & SANTA FE RAILWAY COMPANY
TRACKS IN THE CITY OF BAKERSEIELD WILL BE
UNDERTAKEN.
WUEREAS, the Eederal Highway Administration and the State of California
require that local agencies requesting bridge replacement and rehabilitation
projects furnish evidence that sufficient funds from the local agency are available
and that plans, specifications and estimate be completed within a period of one
year from the date of the notification letter; and
WHEREAS, the 1985-86 fiscal year budget will provide for the City of
Bakersfield's share of the funds necessary to construct the structure widening and
repairs on Oak Street at the Atchison, Topeka and Santa Fe Railway Company tracks
(Public Utilities Commission Crossing No. 2-888.5-A) in the City of Bakersfield;
and
WtlEREAS, the City of Bakersfield wili obtain all necessary orders from
the Public Utilities Commission of the State of California, execute all necessary
agreements with the Atchison, Topeka and Santa Fe Railway Company and accomplish
all other requirements prerequisite 1:o plans, specifications and estimate for
the construction of the structure widening and repairs on Oak Street at the
Atchison, Topeka and Santa Fe Railway Company's track IPublic Uti12ties Crossing
No. 2-888.S~A) in the City of Bakersfield within a per2od of one year from the
date of the notification letter issued by the Department of Transportation of
the State of California on February 2I, 198S, except that an additional four
months will be required if a consultant agreement is involved.
NOW, THEREFORE, BE IT RESOLVED, by the Council of the City of
Bakersfield as follows:
1. That sufficient funds will be available in the City of Bakersfield
1985-86 fiscal year budget; and
2. That the City of Bakersfield intends and expect to have plans,
specifications and estimate for the construction of said structure widening
and repairs on Oak Street at the Atchison, Topeka and Santa Fe Railway's track
5n the CSty of Bakersfield approved for advertising by the Office of Structures
no later than February 21, 1986 or June 21, 1986 if a consultant agreement is
involved; and
3. Authorizes J. Dale Hawley, City Public Works Manager, as agent
of the City to conduct all negotiations, execute and submit all documents
including but not limited to applications, agreements, amendments, payment
requests, ets., which may be necessary for completion of the aforementioned
project.

I HEREBY CERTIFY that the foregoing Resolution was passed and adopted
by the Council of the City of Bakersfield at a regular meeting thereof held on the
