A RESOLUTION OF THE COUNCIL OF THE CITY OF
BAKERSFIELD APPROVING AND ADOPTING SITE PLAN
REVIEW POLICY ADOPTED BY THE PLANNING
COMMISSION REQUIRING ALL NONRESIDENTIAL
DEVELOPMENT TO PAY AN ASSESSMENT TO BE
APPLIED TOWARD THE COST OF IMPROVEMENTS
BENEFITING THE ENTIRE COMMUNITY.
WHEREAS, at its regular meeting held January 3, 1985,
the Planning Commission, by its Resolution No. 7-85, adopted a
site plan review policy which requires all nonresidential develop-
ment to pay an assessment to be applied toward the cost of
improvements benefiting the entire community and forwarded such
Resolution to this Council for approval in accordance with Section
17.53.051 of the Bakersfield Municipal Code; and
WHEREAS, the Urban Development Committee of this Council
has met and discussed such site plan review policy repeatedly
over the past nine months with representatives of the Community
Coalition for Growth-Development-Jobs and the Building Industry
Association, and together with such organizations has examined
the ramifications of, and alternatives to, such policy; and
WHEREAS, the Council[, upon consideration of the recom-
mendations of the Urban Development Committee, has reviewed the
findings set forth in Planning Commission Resolution No. 7-85 and
finds the same to be true and correct.
NOW, THEREFORE, BE IT RESOLVED by the Council of the
City of Bakersfield as follows:
The site plan review policy set forth in Paragraph 3 of
Planning Commission Resolution No. 7-85 is hereby approved and
adopted by this Council, to be applicable to all nonresidential
development which (1) has not received site plan approval prior
to January 1, 1985; or (2) has not met other applicable conditions
of site plan review and for which detailed final construction
drawings, plan check fees and relsted documents have not been
submitted to the City's Building Department for plan check prior
to May 22, 1985; provided, however, such policy shall apply to
each development for which a submission for plan check is made
prior to May 22, 1985, unless application is made and fees paid
for a building permit for the development and such building
permit is issued prior to November 22, 1985.
