HomeMy WebLinkAboutRES NO 14-85RESOLUTION NO. 14-85 A RESOLUTION OF THE COUNCIL OF THE CITY OF BAKERSFIELD MAKING FINDINGS AND APPROVING PROPOSED AMENDMENT TO THE CIRCULATION ELEMENT OF THE BAKERSFIELD METROPOLITAN AREA GENERAL PLAN. WHEREAS, the Council of the City of Bakersfield referred a proposed amendment to the Circulation Element of the Bakersfield Metropolitan Area General Plan to the Planning Commission; and WHEREAS, the Planning Commission of the City of Bakersfield, in accordance with the provisions of Section 65351 of the Government Code, held a public hearing on December 20, 1984, on the proposed amendment to the Circulation Element of the General Plan, notice of the time and place of hearing having been given at least ten (10) calendar days before said hearing by publication in the Bakersfield Californian, a local newspaper of general circulation; and WHEREAS, such amendment to the Circulation Element of the Bakersfield Metropolitan Area General Plan is as follows: The City of Bakersfield has applied to amend the Circulation Element of the Bakersfield Metropc. litan Area General Plan to allow for the southerly realignment of Stockdale High- way for that portion generally located West of Old River Road to the Kern River. WHEREAS, for the above-described amendment, the Planning Commission on December 20, lq84, made findings and recommended certification by the City Council of completion of a Final En%~ironmental Impact Report, and the Council has this date certified as complete said EIR; and WHEREAS, the law and regulations relating to the prepara- tion and adoption of Environmental Impact Reports as set forth in CEOA, the State Environmental Impact Report Guidelines and City of Bakersfield Resolution No. 132-83 have been duly followed by the City staff and Planning Commission. WHEREAS, by Resolution No. 114-84 on December 20, 1984, the Planning Commission recommended approval and adoption of the proposed amendment by this Council; and WHEREAS, the Council of accordance with the provisions of Code, conducted and held a public the City of Bakersfield, in Section 65355 of the Government hearing on February 13, 1985, on the above-described proposed amendment to the Circulation Element of the Bakersfield Metropolitan Area General Plan, notice of time and place of the hearing having been given at least ten (10) calendar days before the hearing by publication in the Bakersfield Californian, a newspaper of general circulation. NOW, THEREFORE, BE IT HEREBY RESOLVED and found by the Council of the City of Bakersfield as follows: The above recitals and findings, incorporated herein, are 2. true and correct· The report of the maps and all reports and papers Planning Commission, including relevant thereto, transmitted the Secretary of the Planning Commission to the City Council, hereby received, accepted and approved. 3.
