HomeMy WebLinkAboutRES NO 13-85RESOLUTION NO. 13-85 A RESOLUTION OF THE COUNCIL OF THE CITY OF BAKERSFIELD MAKING FINDINGS AND APPROVING SEGMENT II OF PROPOSED AMENDMENT TO THE LAND USE ELEMENT OF THE BAKERSFIELD METROPOLITAN AREA GENERAL PLAN (LAND USE AMENDMENT 4-84). WHEREAS, the Council of the City of Bakersfield referred Segment II of a proposed amendment to the Land Use Element of the Bakersfield Metropolitan Area General Plan Commission; and WHEREAS, in accordance with to the Planning the Planning Commission of the City of ~akersfield, the provisions of Section 65351 of the Government Code, held a public hearing on December 20, 1984, on Segment II of a proposed amendment to the Land Use Element of the General Plan, notice of the time and place of hearing having been given at least ten (10) calendar day~ before said hearing by publication in the Bakersfie]d Californian, a local newspaper of general circulation; and WHEREAS, such Segment II o~ the proposed amendment to the Land Use Element of the Rakersfield Metropolitan Area General Plan is as follows: SEGMENT II: Tenneco Property Corporation has applied to amend the Land Use Element to depict the follow- ing designations as described below: Amend the Los Density Residential (0.5 to 5.49 dwelling units per gross acre) designation to Office for a5.] acres generally located Southeast of the intersection of Buena Vista Road and Stockdale Highway. Amend the Land Use Element through expansion to depict Office for 7.2 acres generally located southwest of the intersection of Buena Vista Road and Stockdale Highway. Th~s area is known as the Ruena Vista No. 2 annexation. Amend the Low Density Residential designation to Commercial for 21.6 acres to Office for 6 acres and to High Density Residential (17-45 dwell- ing units per gross acre) for R.4 acres WHEREAS, for the above described Segment, the Planning Commission by its Resolution No. 91-84, made findings and recommended certification by the City Council of completion of the Final Enfironmental Impact Report, and the Council has this ~ate certified as complete said Final EIR; and WHEREAS, the law and regulations relating to the prepara- tion and adoption of Environmental Impact Reports as set forth in CE©A and City of Bakersfield Resolution No. 132-83 have been duly followed by the City staff and Planning Commission. WHEREAS, by Resolution No. 115-84 on December 20, 1984, the Planning Commission recommended approval and adoption of Segment II by this Council; and WHEREAS, the C©unc~l of the City of Bakersfield, in accordance with the provisions of Section 65355 of the Government Code, conducted and held a public hearing on February 13, 1985, on the above-described Segment II of the proposed amendment to the Land Use Element of the Bakersfield Metropolitan Area General Plan, notice of time and place of the hearing having been given at least ten (10) calendar days before the hearing by F~ublication in the Bakersfield Californian, a newspaper of general circulation. NOW, THEREFORE, BE IT HEREBY RESOLVED and found by the Council of the City of Bakersfield as follows: 1. The above recitals and findings, incorporated herein, are true and correct. 2. The report of the Planning Commission, including maps and all reports and papers relevant thereto, transmitted by the Secretary of the Plannin¢~ Commission to the City Council, is hereby received, accepted and approved. 3. The City Council hereby approves and adopts Segment II of the proposed amendment to the Land Use Element of the Bakersfield Metropolitan Area Genera] Plan, subject to the condition that development snbstantially conform to concept plans submitted for those areas depicted as Commercial and High Density Residential, and subject to the mitigation measures set forth in the Environ- mental Impact Report for Section 6. 4. That this Segment the Land Use Element be combined adopted by this City Council, as to form a single II of the proposed amendment to with other segments approved and set forth in separate resolutions, Land Use Element Amendment, 4-84. .......... o0o ..........
