HomeMy WebLinkAboutRES NO 12-85RESOLUWION NO. 12-85 A RESOLUTION OF THE COUNCIL OF THE CITY OF BAKERSFIELD MAKING FINDINGS AND APPROVING SEGMENT I OF PROPOSED AMENDMENT TO THE LAND USE ELEMENT OF THE BAKERSFIELD METROPOLITAN AREA GENERAL PLAN (LAND DSE AMENDMENT 4-84). WHEREAS, Segment I of a proposed amendment to the Land Use Element of Bakersfield Metropolitan Area General Plan to the Planning Commission; and WHEREAS, the Planning Commission of in accordance with the provisions of Section Code, held a public hearing on December 20, 1984, on Segment I of a proposed amendment to the Land Use Element of the GeNeral Plan, notice of the time and place of hearing having been given at least ten (10) calendar days before said hearing by publication in the Bakersfield Californian, a local newspaper of general circulatinn; and WHEREAS, such Segment I of the proposed amendment to the Land Use Element of the Bakersfield Metropolitan Area General Plan is as follows: SEGMENT I: J. Stanley Antongiovanni and Tenneco Property Corporation have applied to amend the Land Use Element of the General Plan through expansion to cover the area generally located north of Panama Lane to the Southern Pacific Railroad, East of Gosford Road to the Arvin-Edison Canal. Proposed Land Use Element designations consist of 16 acres (more or less) of commercial on the Northeast corner of Panama Lane and Gosford Road and Low Density Residential (0.5 to 5.4q dwelling units per gross acre) for the remainder of the site (approximately 336 acres). the Council of the City of Rakersfield referred the the City of Bakersfield, 65351 of the Government WHEREAS, for the above-described Segment, the Planning Commission by its Resolution No. 90-84, made findings and recom- mended certification by the Council of completion of the Final Environmental Impact Report, and the Council has this date certified as complete said Final FIR; and WHEREAS, the law and regulations relating to the prepara- tion and adoption of Environmental Impact Reports as set forth in CEOA, the State Environmental Impact Report Guidelines and City of Bakersfield Resolution No. 132-83 have been duly followed by the City staff and Planning Commission. WHEREAS, by Resolution No. 92-84 on December 20, 1984, the Planning Commission recommended approval and adoption of Segment I by this Council; and WHEREAS, the Council of the City of Bakersfield, in accordance with the provisions of Section 65355 of the Government Code, conducted and held a public hearing on February ]3, 1985, on the above-described Segment I of the proposed amendment to the Land Use Element of the Bakersfield Metropolitan Area General Plan, notice of time and place of the hearing having been given at least ten (10) calendar days before the hearing by publication in the Bakersfield Californian, a newspaper of general circulation. NOW, THEREFORE, BE IT HEREBY RESOLVED and found by the Council of the City of Bakersfield as follows: 1. The above recitals and findings, incorporated herein, are true add correct. 2. The report of the Planning Commission, including maps and all reports and papers relevant the Secretary of the Planning Commission hereby received, accepted and approved. thereto, transmitted by to the City Council, is 3. The City Council hereby approves and adopts Segment I of the proposed amendment to the Land Use Element of the Bakersfield Metropolitan Area Genera] Plan, subject to the conditions that the Stine Canal be relocated to provide a land use buffer as shown on conceptual plans submitted by the applicant, that develop- ment comply substantially to the conceptual plan submitted with this project, and subject to mitigation measures set forth in the Environmental Impact Report for Sections 21 and 22. 4. That this Segment I of the proposed amendment to the [,and Use Element be combined with other segments approved and adopted by this City Council, as set forth in separate resolutions, to form a single Land Use Element Amendment, 4-84. .......... o0o ..........
