Minutes of the Regular Meeting of the Council of the
City of Bakersfield, Calitornia, for the purpose of a Closed
Session held in the Council Chambers of City Hall, at 5:15 p.m.,
May 3, 1988.
The meeting was called to order by Mayor Payne.
City Clerk Williams called the roll as follows:
Present:
Mayor Payne.
Absent: None
Councilmembers Childs, DeMond, Smith,
Ratty, McDermott, Salvagglo
Peterson (seated at 5:20
p.m.)
CLOSED SESSION
Closed Session pursuant to Government
Code Section 54956o9(a) regarding
Terry L. Moreland vs. City of Bakerstleld.
Upon a motion by Councilmember Childs, the Council
adjourned to Closed Session pursuant to government Code Section
54956.9(a) regarding Terry L. Moreland vs. City of Bakersfield at
5:22 p.m. The meeting reconvened at 7:40 p.m.
Mayor Payne stated that Councilmember Ratty is absent
and asked City Attorney Saaltleld to explain why.
City Attorney Saaltield stated that during the discus-
sion with respect to the proposed settlement of the matter
considered in Closed Session it became apparent that one issue
that was related to that settlement involved the development ot
property in very close proximity to property owned by
Councilmember Ratty. At that point Councilmember Ratty was
advised that it would be appropriate for him to disquality him-
selt trom further participation in the discussions.
Councilmember Ratty lett the Closed Session at that point.
Upon a motion by Councilmember Peterson, settlement
Agreement between Terry Moreland Incorporated, Terry Moreland as
an Individual, the City of Bakerstleld Central District
Development Agency, subject to approval of the Central District
Development Agency, was approved, and the Mayor was authorized to
execute upon the approval ot the Central District Development
Agency, as to form approved by the City Attorney's Ottlce.
ADJOURNMENT
There being no tufther business to come betore the
Council, upon a motion by Councilmember McDermott, the meeting
was adjourned at 7:45 p.m.
