A RESOLUTION DISPENSING WITH BIDDING PROCEDURES DUE TO
EMERGENCY SEWER REPAIRS AT THE INTERSECTION OF
BRUNDAGE LANE AND MT. VERNON AVENUE, NOT TO EXCEED
SIX HUNDRED SIXTY THOUSAND DOLLARS ($660,000.00).
WHEREAS, on Wednesday afternoon, December 21, 2005, Streets Division staff
responded to a call regarding a sewer pipe failure at the southeast corner of Mt. Vernon Avenue
and Brundage Lane; and
WHEREAS, Streets Division staff discovered that the failure was due to the cave in of a
portion of the 42 inch concrete sewer main line; and
WHEREAS, the exposed part of the sewer line appeared to be decayed and it is the
main sewer line that runs under the intersection of Mt. Vernon Avenue and Brundage Lane, then
west under Brundage Lane to "L" Street. The Public Works Director was immediately notified
and summoned to the site; and
WHEREAS, the Public Works Director and staff conducted a visual inspection of the
exposed sewer pipe and a video inspection of the portion that runs under the Mt. Vernon
Avenue and Brundage Lane intersection; and
WHEREAS, after completing a visual and video inspection of the sewer line and
considering that the sewer line was installed in 1912, the Public Works Director declared this
problem an emergency and the work to be performed was of urgent necessity for the
preservation of life, health or property; and
WHEREAS, the nature of the repair required installation of a new 42 inch concrete
sewer line and the use of outside forces to perform the sewer line repair in a safe and timely
manner; and
WHEREAS, to remedy this emergency, the Public Works Director authorized Granite
Construction Company, on a time-materials basis, to replace a portion of the 42 inch concrete
sewer line. The Public Works Director also authorized other expenses required for this
emergency.

NOW, THEREFORE, BE IT RESOLVED AS FOLLOWS:
1. The above recitals are true and correct and incorporated herein by reference.
2. City Council hereby determines that based on the above recitals, the work
performed was of urgent necessity for the preservation of life, health or property,
thereby allowing the dispensing of bidding requirements as set forth in Section
136 of the City Charter and Section 3.20.060 of the Bakersfield Municipal Code.
3. The Finance Director is authorized to dispense with bidding in accordance with 'òM<¿:-",
