O· .~ :It ':: () If RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BAKERSFIELD APPROVING ADMINISTRATIVE REVIEW # 05-1207 RESCINDING WAIVER OF DIRECT ACCESS THEREBY GRANTING DIRECT ACCESS ONTO HAGEMAN ROAD FROM 8200 HAGEMAN ROAD. WHEREAS, Porter-Robertson, representing BRH, LLC, the property owner, filed an application requesting waiver of direct access be revised to allow an exit only driveway from 8200 Hageman Road (Parcel 1 , PM 11112) onto Hageman Road, as shown in attached Exhibits "2" and "3"; and WHEREAS, the Planning Commission, through its Secretary, did set, THURSDAY, December 1, 2005 at the hour of 5:30 p.m. in the Council Chambers of City Hall, 1501 Trux1un Avenue, Bakersfield, California. as the time and place for consideration of the Planning Director's report; and WHEREAS, by Resolution NO.175-05 on December 1, 2006, Administrative Review No. 05-1207 was not approved by operation of law because no motion received a majority vote of the Planning Commission; and WHEREAS, Harold Robertson, Porter-Robertson, filed a written appeal within the appeal period with the City Clerk; and WHEREAS, the Council of the City of Bakersfield conducted and held a public hearing on WEDNESDAY, January 25,2006 on the above described Administrative Review No. 05-1207, giving notice of time and place of the hearing at least ten (10) calendar days before the hearing by publication in the Bakersfield Californian, a local newspaper of general circulation; and WHEREAS, the laws and regulations relating to CEQA and the City of Bakersfield's CEQA Implementation Procedures, have been duly followed by city staff and the Planning Commission; and WHEREAS, the above described project is Categorically Exempt from the requirements of the California Environmental Quality Act in accordance with Section 15061 (b)(3) , and WHEREAS, this Council has fully considered the findings made by the Planning Commission as set forth in that Resolution; and WHEREAS, at said meeting held January 25, 2006 said request submitted by Porter- Robertson, was duly considered, and the City Council found as follows: 1. All required notices have been given. 2. The provisions of the California Environmental Quality Act (CEQA) have been followed. !< 'QMf'9 a ~ >- - I- m _ r- " t:> ORIGINAL 3. Pursuant to the California Environmental Quality Act (CEQA) 15061 (b)(3), general rule, exemption from the requirements of CEQA. This request because it will not affect the environment. 4. The request is in accordance with Bakersfield Municipal Code Sections 16.28.190 (A)(4) and 16.40.020. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF BAKERSFIELD as follows: 1. That the above recitals, incorporated herein, are true and correct. 2. That the project is exempt from CEQA. 3. The developer shall install appropriate signage to limit the access to exit only onto Hageman Road. 2. The developer shall obtain the appropriate permits (encroachment) and construct the driveway to City standards. 3. Prior to completion of the construction of the driveway, the developer shall record a covenant on Parcel 1 , Parcel Map 11112 (8200 Hageman Road) that specifically limits the driveway to exit only. Prior to recordation of the covenant, developer shall obtain approval of the covenant from the City Attorney. The covenant shall run with the land and may not be amended or rescinded without City of Bakersfield approval. 4. In consideration by the City of Bakersfield for land use entitlements, including but not limited to related environmental approvals related to or arising from this project, the applicant, and/or property owner and/or subdivider ("Applicant" herein) agrees to indemnify, defend, and hold harmless the City of Bakersfield, its officers, agents, employees, departments, commissioners or boards ("City" herein) against any and all liability, claims, actions, causes of action or demands whatsoever against them, or any of them, before administrative or judicial tribunals of any kind whatsoever, in any way arising from, the terms and provisions of this application, including without limitation any CEQA approval or any related development approvals or conditions whether imposed by the City, or not, except for CITY's sole active negligence or willful misconduct. This indemnification condition does not prevent the Applicant from challenging any decision by the City related to this project and the obligations of this condition apply regardless of whether any other permits or entitlements are issued. The City will promptly notify Applicant of any such claim, action or proceeding, falling under this condition within thirty (30) days of actually receiving such claim. The City, in its sole discretion, shall be allowed to choose the attorney or outside law firm to defend the City at the sole cost and expense of the Applicant and the City is not obligated to use any law firm or attorney chosen by another entity or party.
