A RESOLUTION OF THE COUNCIL ORDERING THE VACATION OF THE
26-FOOT WIDE PRIVATE ACCESS EASEMENT LOCATED AT THE
SOUTHWESTERLY CORNER OF WESTWIND DRIVE AND 19TH STREET,
AS SHOWN ON PARCEL A OF PARCEL MAP WAIVER 25-91
WHEREAS, Allen Hubsch on behalf of the ownership of 1801 Westwind Drive
had submitted a request for the surnrnary vacation of the 26-foot wide private access
easernent on Parcel A of Parcel Map Wiaver 25-91; and
WHEREAS, the subject street is eligible for surnrnary vacation per Section 8331
of the Streets and Highways Code which authorizes the City Council to surnmarily
vacate a street or highway if (a) for a period of five consecutive years, the street or
highway has been impassable for vehicular travel or (b) no public rnoney was expended
for rnaintenance of the street or highway during such period; and
WHEREAS, for the above-described project, it was deterrnined that the proposed
vacation is exempt frorn CEQA, pursuant to Section 15061 (b) (3) of CEQA Guidelines
(General Rule) in that there is no possibility that the proposed action could have a
significant effect on the environrnent; and
WHEREAS, Planning department approved the vacation on December 2, 2005
per local ordinance and found to be consistent with the Metropolitan Bakersfield
General Plan.
NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Bakersfield
as follows:
1. The above recitals are true and correct and are incorporated herein.
2. This Resolution is adopted pursuant to Section 8300, et seq. of the Streets and
Highways Code of the State of California.
3. The Council orders the vacation of the 26-foot wide private access easement on
Parcel A of Parcel Map Waiver 25-91 in the City of Bakersfield, County of Kem, State of
California, more particularly described in Exhibit "A" and shown in Exhibit "S", attached
hereto and rnade part hereof.
4. There is no condition for completion for the said street vacation, pursuant to
Section 8324 (b) of the Streets and Highways Code of the State of the California.
5. The City Clerk shall certify to the passage of this resolution and shall cause a
certified copy hereof, attested by the Clerk under the seal of the City, to be recorded in
the Office of the County Recorder of the County of Kern, California.

LEGAL DESCRIPTION
All that portion of the 26-foot wide strip of land located on the East half of Section 26,
Township 29 South, Range 27 East, Mount Diablo Base and Meridian, in the City of
Bakersfield, County of Kern, State of California, rnore particularly described as follows:
Lying 11.00 feet North of the boundary line of Parcels A and B of Parcel Map Waiver
25-91, filed for record on November 15, 1991 in Book 6594, at Page 2015 in the Office
of the Kern County Recorder; thence 253.00 feet Westerly of the West right of way line
of Westwind Drive; thence 44.00 feet Northerly and parallel with said West right of way
line of Westwind Drive.
