A RESOLUTION OF THE COUNCIL ORDERING THE VACATION OF THE
FUTURE STREET AT FILSON STREET, EAST OF HALE STREET
AS SHOWN ON PARCEL MAP 1443
WHEREAS, Charles Fletcher and Steven Earnest, both property owners, have
subrnitted a request to have the future street, as shown on Parcel Map 1443, vacated;
and
WHEREAS, the subject street is eligible for sumrnary vacation per Section 8331
of the Streets and Highways Code which authorizes the City Council to surnmarily
vacate a street or highway if (a) for a period of five consecutive years, the street or
highway has been irnpassable for vehicular travel or (b) no public money was expended
for rnaintenance of the street or highway during such period; and
WHEREAS, for the above-described project, it was deterrnined that the proposed
vacation is exernpt frorn CEQA, pursuant to Section 15061 (b) (3) of CEQA Guidelines
(General Rule) in that there is no possibility that the proposed action could have a
significant effect on the environrnent; and
WHEREAS, Planning departrnent approved the vacation on Decernber 15, 2005
per local ordinance and found to be consistent with the Metropolitan Bakersfield
General Plan.
NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Bakersfield
as follows:
1. The above recitals are true and correct and are incorporated herein.
2. This Resolution is adopted pursuant to Section 8300, et seq. of the Streets and
Highways Code of the State of California.
3. The Council orders the vacation of the future street located at Filson Street, east
of Hale Street in the City of Bakersfield, County of Kern, State of California, more
particularly described in Exhibit "A" and shown in Exhibit "B", attached hereto and rnade
part hereof.
4. There is no condition for cornpletion for the said street vacation, pursuant to
Section 8324 (b) of the Streets and Highways Code of the State of the California.
5. The City Clerk shall certify to the passage of this resolution and shall cause a
certified copy hereof, attested by the Clerk under the seal of the City, to be recorded in
the Office of the County Recorder of the County of Kern, California.

LEGAL DESCRIPTION
All that portion of strip of land located on Section 16, Township 30 South, Range 28
East, Mount Diablo Base and Meridian, in the City of Bakersfield, County of Kern, State
of California, more particularly described as follows:
The 60 feet wide and 135.17 feet long strip of land, easterly frorn the East right of way
line of Hale Street, being 30 feet either way frorn the property boundary line of Lots 5
and 6 of Tract No. 1443, filed for record on July 21, 1948 in Book 6 of Maps, at Page
140, in the Office of the Kern County Recorder.
