HomeMy WebLinkAboutRES NO 020-06 RESOLUTION NO. 020-06 A RESOLUTION FINDING THE PURCHASE OF CERTAIN REAL PROPERTY TO BE EXEMPT FROM THE CALIFORNIA ENVIRONMENTAL QUALITY ACT. WHEREAS, the Fruitvale Union School District ("the District") owns a one-acre parcel of property adjacent to Endeavor School ("the Property") which they do not need for school use; and WHEREAS, the location of the Property is an ideal location for a fire station; and WHEREAS, on December 13, 2005, the District's Board of Trustees adopted Resolution #0506-07 declaring its "Intention to Sell Real Property to Another Public Agency"; and WHEREAS, that resolution contains the legal description of the Property and sets forth the District's intention to sell the Property to the City of Bakersfield ("City"), providing that certain conditions are met; and WHEREAS, City intends to meet those conditions; and WHEREAS, pursuant to California law, that resolution was published once a week for three weeks; and WHEREAS, in accordance with Section 2.28.120, the Planning Director has found the acquisition of the Property to be consistent with the General Plan; and WHEREAS, City staff has made the determination that acquiring the property is exempt from the California Environmental Quality Act ("CEQA") in that there is no potential for the acquisition to have a significant impact on the environment (14 California Code of Regulations section 15061 (b )(3) - General Rule). NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Bakersfield as follows: 1. The above recitals and findings are true and correct and are incorporated herein by reference; and 2. The purchase of the Property is exempt from the California Environmental Quality Act, in that there is no potential for any significant impact on the environment (14 California Code of Regulations 15061 (b)(3) - General Rule; and 3.
