WHEREAS, on WEDNESDAY, DECEMBER 17, 1997, the Council of the City of Bakersfield, pursuant to the provisions of the "Public Streets, Highways and Service Easements Vacation Law," being Chapter 3 of Part 3 of Division 9 of the Streets and Highways Code of the State of California, passed and adopted its Resolution of Intention No. 1167 declaring its intention to order the vacation of 22'a, 23d and "S" Streets abutting Blocks 144, 145, 174, 175, 184 and 185 and all alleys within these blocks in the City of Bakersfield; and WHEREAS, for the above-described project, it was determined that the proposed vacation is exempt from CEQA according to Section IV.B3(f) of City of Bakersfield CEQA Implementation Procedures, pursuant to Section 15305 of CEQA Guidelines (Class 5) in that there is no possibility that the street and alley right of way vacation and proposed use could have a significant effect on the environment; and WHEREAS, at its meeting on September 18, 1997, the vacation was duly heard and considered by the Planning Coinmission and was found to be consistent with the Metropolitan Bakersfield General Plan; and WHEREAS, said Council did fix a time and place for hearing all persons interested in or objecting to said proposed vacation, which hearing was held on Wednesday, January 28, 1998, after notices were duly published and posted as required by law. -1- ORIGINAL NOW, THEREFORE BE IT RESOLVED by the Council of the City of Bakersfield as follows: 1. The above recitals are true and correct and are incorporated herein. All of the 82.5 foot wide public street right of way for 22nd Street bounded westerly by the east right of way line of "R" Street and bounded easterly by the west right of way line of "T" Street (closed November 25, 1923); all of the 82.5 foot wide public street right of way for 23ra Street bounded westerly by the east right of way line of "R" Street and bounded easterly by the west right of way line of "T" Street (closed); all of the 82.5 foot wide public street right of way for "S" Street bounded southeriy by the north right of way line of 2Pt Street and bounded northerly by the south right of way line of 244 Street; all of the 20 foot wide public alley fight of way in Blocks 144, 145, 174 and 175 bounded by the north and south lines of said blocks; all of the 33 foot wide alley right of way in Blocks 185 and 184 bounded by the east and west lines of said blocks, as said streets, alleys and blocks area shown on "Map of the City of Bakersfield" filed for record November 25, 1898 in the office of the Kern County Recorder, is unnecessary for present or prospective use for public street or alley purposes and is hereby vacated, subject to the conditions enumerated herein. A non-exclusive easement shall be reserved for public utilities purposes in, under, over and upon the above described 20 foot wide public alley right of way in said Block 144 and the 33 foot wide public alley right of way in said Block 185. Full access for utilities shall be maintained to the greatest extent possible. A non-exclusive easement shall be reserved for public sewer line purposes in, under and upon the south 40 feet of the west 155.50 feet of the above described portion of 23rd Street. The City Clerk shall certify to the passage of this Resolution and shall cause a certified copy hereof, attested by the Clerk under the seal of the City. to be recorded in the Office of the County Recorder of the County of Kern, California. ...... o0o ......
