Home My WebLink AboutRES NO 25-98RESOLUTION NO. ~, 5 - .0 8 RESOLUTION ADOPTING A PARK FACILITIES PLAN FOR PARKS LOCATED WITHIN THE NORTH BAKERSFIELD RECREATION AND PARK DISTRICT. WHEREAS, on November 5, 1997, the City Council adopted an ordinance amending Bakersfield Municipal Code Section 15.82.070 authorizing collection of a park development fee within the North Bakersfield Recreation and Park District pursuant to Government Code Section 66000 et seq; and WHEREAS, in said Government Code section, the local agency may adopt and annually update a park facilities plan or similar plan identifying the facilities to be funded by said fee; and WHEREAS, on January 15, 1998, the Planning Commission determined that the Park Facilities Plan attached hereto as Exhibit "A," is consistent with the Metropolitan Bakersfield 2010 General Plan and RiverLakes Ranch Specific Plan; and WHEREAS, the Council of the City of Bakersfield conducted and held a public hearing on Wednesday, February 25, 1998, on the adoption of the Park Facilities Plan attached hereto as Exhibit "A"; and WHEREAS, the Park Facilities Plan is based on the North Bakersfield Recreation and Park District 2010 Capital Improvement Plan adopted by the District's Board of Directors; and WHEREAS, based on recent subdivision activity, the North Bakersfield Recreation and Park District has indicated that there is an expected need for an estimated 12.5 acre park to be located in the area generally west of Allen Road, between the Kern River Freeway and Stockdale Highway; WHEREAS, the City Council desires to include this future park in the Park Facilities Plan; and WHEREAS, the plan for the parks located within the city limits of the district as shown in the 2010 Park Facilities Plan and herein attached Exhibit "A", if adopted by the City Council, is adequate to satisfy the requirement of said Government Code Section 66002; and ORJGINA~ WHEREAS, the following district parks are located within the city limits and are included in the 2010 Park Facilities Plan: PARK LOCATION ACRES 1. Future Park SEC Noriega & Old Farm 40 RiverLakes Dr., south of Hageman 28 Snow Rd. at Friant Kern Canal 12 SEC Jewetta & Brimhall 21.3 Between Kern River Freeway and Stockdale Highway, west of Allen Rd. 12.5 est. and; WHEREAS, the environmental review prepared and the Negative Declaration adopted for said ordinance amendment is adequate for this project; and WHEREAS, the law and regulations relating to CEQA and the City of Bakersfield's CEQA Implementation Procedures have been duly followed; and NOW, THEREFORE, BE IT RESOLVED and found by the Council of the City of Bakersfield as follows: 1. The above recitals and findings, incorporated herein, are true and correct. 2. The Negative Declaration adopted on November 5, 1997 by the City Council in relation to the ordinance amending Section 15.82.070 authorizing collection of park development fees within the North Bakersfield Recreation and Park District is adequate for this project. 3.
