HomeMy WebLinkAboutRES NO 044-06 RESOLUTION NO. 04-1=06 RESOLUTION OF THE COUNCIL OF THE CITY OF BAKERSFIELD CERTIFYING IT HAS RECEIVED, REVIEWED, EVALUATED AND CONSIDERED THE INFORMATION CONTAINED IN THE FINAL ENVIRONMENTAL IMPACT REPORT FOR GENERAL PLAN AMENDMENT AND CONCURRENT ZONE CHANGE NO. 04-1746 AND CERTIFYING THAT THE FINAL ENVIRONMENTAL IMPACT REPORT HAS BEEN COMPLETED IN COMPLIANCE WITH THE CALIFORNIA ENVIRONMENTAL QUALITY ACT, THE STATE CEQA GUIDELINES, AND THE CITY OF BAKERSFIELD CEQA IMPLEMENTATION PROCEDURES, AND MAKING FINDINGS AND ADOPTING A MITIGATION MONITORING PLAN. WHEREAS, the Planning Commission of the City of Bakersfield in accordance with the provisions of Section 65353 of the Government Code, held a public hearing on Monday, December 12, 2005, and on Thursday, December 15, 2005, on the certification of the Final Environmental Impact Report (EIR) for General Plan AmendmenUZone Change No. 04-1746 for the proposed amendment to the Land Use Element of the Metropolitan Bakersfield General Plan and the proposed zone change, notice of the time and place of hearing having been given at least ten (10) calendar days before said hearing by pUblication in The Bakersfield Californian, a local newspaper of general circulation; and WHEREAS, Mcintosh & Associates for Centex Homes made application for a concurrent general plan amendment and zone change for property generally located north and south of Taft Highway (SR 119), between Ashe Road and future Mountain Ridge Road, as shown in attached Exhibit "A," to allow development of a single-family residential development on 186,66 acres, more specifically stated as follows: General Plan Amendment No. 04-1746: A request to amend the Land Use Element of the Metropolitan Bakersfield General Plan from R-IA (Resource -Intensive Agriculture) to LR (Low Density Residential) on 80.07 acres, from RR (Rural Residential) to LR on 37.06 acres, and from RR to LMR (Low Medium Density Residential) on 69.53 acres. Concurrent Zone ChanGe No. 04-1746: A concurrent zone change requesting a change in zone from A (Agriculture) to R-1 (One Family Dwelling) on 117.13 acres, from A to R-2 (Limited Multiple Family Dwelling) on 12.94 acres, and from R-S-20A (Residential Suburban, 20-acre minimum lot size) to R-2 on 56,59 acres. WHEREAS, for the above-described project, it was determined that'the proposed project may have a significant effect on the environment and, therefore, an EIR was required for the project in accordance with the California Environmental Quality Act (CEQA); and WHEREAS, the City of Bakersfield retained the professional consulting services of Michael Brandman Associates to prepare the Initial Study, EIR and related documents; and WHEREAS, by Resolution No. 201-05 on December 15, 2005, the Planning Commission ~A/{ recommended certification ofthe Final EIR for General Plan AmendmenUZone Change No. 04-1746 r;} ~t. and this Council has fully considered the findings made by the Planning Commission as set forth in ~ .." that Resolution and as restated herein; and Q /!! OR/G/NAP WHEREAS, a Notice of Preparation was filed with the State Clearinghouse on April 6, 2005, for a 30-day review period in accordance with CEQA; and WHEREAS, a Public Scoping hearing was held on May 3, 2005, to receive input from the public and agencies on the Initial Study and scope of the Draft EIR; and WHEREAS, a Draft EIR was prepared and circulated to interested parties and agencies and a notice of availability was sent to property owners within 300 feet of the project site and all those who requested notification at the Planning Commission public hearing(s) or requested special notice to the Development Services Department on September 30, 2005, in accordance with CEQA for a 45-day review period to end on November 14, 2005, in accordance with Section 15087 of the State CEQA Guidelines; and WHEREAS, the public hearing on the Draft EIR was held during the latter half of the public review period as is required by the City of Bakersfield CEQA Implementation Procedures; and WHEREAS, the Notice of Completion was filed with the State Clearinghouse and the Draft EIR was submitted to the State Clearinghouse (SCH #2005041 033) on September 30,2005, to start the 45-day review period to end on November 14, 2005, in accordance with CEQA; and WHEREAS, the Planning Commission of the City of Bakersfield in accordance with the provisions of the City of Bakersfield CEQA Implementation Procedures, held a public hearing on Thursday, December 15, 2005, on the adequacy of the Draft EIR; and WHEREAS, on December 5, 2005, the Final EIR was completed and notice of its availability was made to interested parities and agencies; and WHEREAS, on December 15, 2005, the Planning Commission considered the Final EIR; and WHEREAS, based on comments received prior to and at the December 15, 2005, Planning Commission Hearing, the Planning Commission recommended certification of the Final EIR; and WHEREAS, the environmental record prepared in conjunction with the project includes the following: 1. The Notice of Preparation, Draft Environmental Impact Report, and Final Environmental Impact Report; 2. All staff reports, memoranda, maps, letters, minutes of meetings relating to the project; 3. All testimony, documents and evidence presented to the City by consultants working with the City relating to the project; 4. The proceedings before the Planning Commission relating to the project, the Draft EIR and the Final EIR, including testimony and documenting evidence introduced at the public hearings; and 5. Matters of common knowledge to the Planning Commission which it considered including but not limited to the following: 2 !<~AK~'9. C) iP >- .... I- - - f!! .., ORIGINAl.. t> a) The Metropolitan Bakersfield General Plan; b) The City of Bakersfield Zoning Ordinance; c) The City of Bakersfield Municipal Code; d) Other formally adopted policies and ordinances of the City of Bakersfield; and WHEREAS, the Planning Commission adopted Resolution No. 201-05 on December 15, 2005, recommending certification of the Final EIR for General Plan Amendment/Zone Change No. 04-1746; and WHEREAS, the Council has considered and concurs with the following findings made by the Planning Commission as set forth in Resolution No. 201-05, adopted on December 15, 2005: 1. The laws and regulations relating to the preparation and adoption of Environmental Impact Reports as set forth in CEQA, the State CEQA Guidelines, and the City of Bakersfield CEQA Implementation Procedures, have been duly followed by city staff and the Planning Commission; and 2. The Final EIR for GPAlZC 04-1746 was prepared in accordance with CEQA Guidelines Section 15132; and 3. In accordance with State CEQA Guidelines Section 15151, the Planning Commission considered the following direction regarding "standards for adequacy" of an EIR: An EIR should be prepared with a sufficient degree of analysis to provide decision- makers with information which enables them to make a decision which intelligently takes account of environmental consequences, An evaluation of the environmental effects of a proposed project need not be exhaustive, but the sufficiency of an EIR is to be reviewed in the light of what is reasonably feasible. Disagreement among experts does not make an EIR inadequate, but the EIR should summarize the main points of disagreement among the experts. The courts have looked not for perfection but for adequacy, completeness, and a good faith effort at full disclosure; and 4. In accordance with CEQA Guidelines Sections 15151 and 15090, the Final EIR was considered for adequacy, completeness and good faith effort at full disclosure and has been completed in compliance with CEQA; and 5. Attached Exhibit "B" containing the "Statement of Facts, Findings, and Mitigation Measures" are appropriate and incorporated into the project; and 6. Attached Exhibit "C" containing the "Mitigation Monitoring and Reporting Program" is incorporated into the project; and WHEREAS, in accordance with State CEQA Guidelines Section 15132, the Final EIR consists of the following: 1. A list of persons, organizations and public agencies commenting on the Draft EIR; 4. The responses of the Lead Agency to significant environmental points raised in the review and consultation process; and WHEREAS, the Final EIR for General Plan Amendment/Zone Change No. 04-1746 was prepared in accordance with State CEQA Guidelines Section 15132; and WHEREAS, in accordance with State CEQA Guidelines Section 15090 the lead agency (City of Bakersfield) shall certify that: (a) The Final EIR has been completed in compliance with CEQA; and (b) The Final EIR was presented to the decision-making body of the Lead Agency and that the decision-making body reviewed and considered the information contained in the Final EIR prior to approving the project. WHEREAS, in accordance with State CEQA Guidelines Sections 15151 and 15090, the Final EIR was considered for adequacy, completeness and good faith effort at full disclosure and has been completed in compliance with CEQA; and WHEREAS, the Final EIR analyzed a reasonable range of altematives to the project, each of which has been rejected as infeasible due to specific considerations in accordance with State CEQA Guidelines Section 15091, as supported by the substantial evidence contained in the "Statement of Facts, Findings, and Mitigation Measures" in Exhibit "B"; and NOW,THEREFORE, BE IT RESOLVED AND FOUND BY THE COUNCIL OF THE CITY OF BAKERSFIELD as follows: 1. The City Council hereby certifies that it has received, reviewed, evaluated and considered the information contained in the Final EIR for General Plan Amendment/Zone Change No. 04-1746. 2. The City Council hereby certifies the Final EIR for General Plan Amendment/Zone Change No. 04-1746. 3. The above recitals and findings incorporated herein by reference are true and correct and constitute the Findings of the City Council in this matter. 4. That all required notices have been given. 5. The provisions of CEQA have been followed. 6. The City Council hereby finds the mitigation incorporated into the project avoids impacts or mitigates impacts to a less than significant level. 7. Based on the absence of evidence in the record as required by Section 21082.2 of the State of California Public Resources Code (CEQA) for the purposes of documenting significant effects, it is the conclusion of the Lead Agency that this project will result in impacts that fall below the threshold of significance with regard to wildlife resources and, therefore must be granted a "de minimis" exemption in accordance with Section 711 of the State of California Fish and Game Code. 4 ~ 'òþ.Kê~ Q ~ >- - m I;:;. r-- () t) ORIGINAL Additionally the assumption of adverse effect is rebutted by the above-referenced absence of evidence in the record and the lead agency's decision to prepare an Environmental Impact Report for this project. 8. The Final EIR has been reviewed by the City Council of the Lead Agency and the findings contained therein reflect the City Council's independent judgment and analysis. 9. All of the foregoing findings are supported by substantial evidence in the record of the proceedings before the Planning Commission, which is maintained by the City's Planning Director in the Planning Department's offices at 1715 Chester Avenue, Bakersfield, CA 93301, and of the proceedings before the City Council, which is maintained by the City Clerk in the City Clerk's offices at 1501 Truxtun Avenue, Bakersfield, CA 93301. 10. The Planning Division of the Development Services Department is hereby directed to file a Notice of Determination with the County Clerk of Kern County, pursuant to the provision of Section 21152 of the Public Resources Code and Section 15094 of the State CEQA Guidelines adopted pursuant thereto and a Certificate of Fee Exemption pursuant to Section 711.4 (c)(2)(B) ofthe State of California Department of Fish and Game Code. ---------000-------- 5 ~ 'òA/(~?- o 0 >- :'. Zone Change 04-1746 and Ashe No.3 Annexation CEQA Findings and Findings of Fact Introduction SECTION 1: INTRODUCTION In compliance with the requirements of the California Environmental Quality Act (CEQA) and the CEQA Guidelines; the City of Bakersfield has conducted an environmental review of the proposed project. A Notice of Preparation was released for public review in April 2005, In September 2005, the Draft EIR was released. After receiving public comment on the Draft EIR, the City prepared a document entitled Responses to Comments on the Draft EIR (RTC). The RTC document includes the verbatim comments received on the Draft EIR, a list of those commenting, and the City's responses to the significant environmental points raised in the review and consultation process, In response to certain comments, the Draft EIR was modified, as set forth in the responses to comments. The Final EIR for the project consists of the Draft EIR and the RTC document. The RTC provides responses to comments on environmental issues describing the disposition of the issues, explaining the EIR analysis, supporting the EIR conclusions, and/or providing information or corrections as appropriate. These Findings are based upon the information in the record of proceedings, including the Final EIR, staff reports, project applicant's materials, Mitigation Monitoring Program, and the testimony presented at public hearings, CEQA provides in relevant part, at Public Resources Code Section 21081, that: [N]o public agency shall approve or carry out a project for which an environmental impact report has been certified which identifies one or more significant effects on the environment that would occur if the project is approved or carried out unless both of the following occur: (a) the public agency makes one or more of the following findings with respect to each significant effect: I. Changes or alterations have been required in, or incorporated into, the project which mitigate or avoid the significant effects on the environment. 2. Those changes or alterations are within the responsibility and jurisdiction of another public agency and have been, or can and should be, adopted by that other agency, 3. Zone Change 04-1746 and Ashe No.3 Annexation CEQA Findings and Findings of Fact Introduction (b) With respect to significant effects which were subject to a finding under paragraph (3) of subdivision (a), the public agency finds that specific overriding economic, legal, social, technological, or other benefits of the project outweigh the significant effects on the environment. Because the project Environmental Impact Report (EIR) identified significant effects that may occur as a result ofthe project, and in accordance with the provisions of CEQA and the CEQA Guidelines, the City Council of the City of Bakersfield hereby adopts these Findings. For each ó[the significant effects identified in Section 3, as set forth in greater detail in these Findings below, 1he City Council makes the finding under paragraph (I) of subdivision (a) above. For each of the significant effects identified in Section 4, as set forth in greater detail in these Findings below, the City Council makes the finding under paragraph (3) of subdivision (a) and under subdivision (b) above. CEQA requires that the EIR reflect the City's own independent judgment and review, Accordingly, the City Council expressly finds that the Final EIR for the project reflects the City's independent judgment. Zone Change tJ4..1746 and Ashe No.3 Annexation CEQA FIndings and Findings 01 Fact Project Description SECTION 2: PROJECT DESCRIPTION The proposed project is the development of a single-family residential community on 186,66 acres that includes approximately 874 single-family residential units. The gross density is 3,13 units per acre with a net density of 5,96 units per acre. Project implementation will require a General Plan Amendment to re-designate 80,07 acres from Resource Intensive Agriculture (R-IA) to Low Density Residential (LR), 36,56 acres from Rural Residential (RR) to LR, and 70,03 acres from RR to Low Medium Density Residential (LMR) (see Exhibit 3-3). Zone Change 04-1746 and Ashe No.3 Annexation CEQA Findings and Findings of Fact Mitigated Project Lave/and Cumulative Adverse Impacts SECTION 3: MITIGATED PROJECT -LEVEL AND CUMULATIVE ADVERSE IMPACTS The EIR identified significant project-level and cumulative adverse impacts of the proposed project and proposed mitigation measures to avoid or substantially lessen those impacts. Those impacts and mitigation measures are identified in the following sections, The Bakersfield City Council finds, based on the record and on the facts as set forth below, that the incorporation of the identified mitigation measures will mitigate all of the identified significant project-level and cumulative adverse impacts to a level that is considered less than significant. Implementation of the proposed project will result in the gene~tion 00,991 average daily trips that will be added to the existing and planned circulation infrastructure within the project area, which will result in an unacceptable level of service (LOS) at one intersection in the year 20 I 0 (Taft Highway at Mountain Ridge Drive) and two intersections in the year 2030 (Ashe Road at McCutchen RoadIHosking Avenue and Stine Road at Hosking Avenue), Finding Changes or alterations have been required in, or incorporated into, the project, which mitigate or avoid the significant effects on the environment. Facts in Support of Finding TT 5.1-1 Prior to 1he issuance of building permits, the project applicant shall pay the proportionate share for local mitigation improvements (those not covered by the Regional Transportation Impact Fee [RTIF] program) as follows: Year 2010 Intersections · Install an eastbound turn lane at the intersection of Taft Highway and Mountain Ridge Road, Year 2030 Inlerseclions · Provide an all-way stop at the intersection of Ashe Road and McCutchen RoadIHosking Avenue; and · Install a signal at the intersection of Stine Road and Hosking Avenue, 3.2 . With the R-IA designation, parcels must be a minimum of20 acres, Under the RR designation, each developed unit must be on at least a 2,5-acre parcel. Thus, under the limitations of the General Plan, there could be a maximum of 42 developed units on the project site, This alternative would result in 832 less residential dwelling units than the proposed project, It is using this assumption that this alternative is compared to the proposed project. The General Plan Alternative would result in fewer transportation/traffic, air quality, noise, utility and service system, hazards and hazardous materials, biological resources, cultural resources, and agricultural resources impacts in comparison to the proposed project.
