The appeal must be filed in writing within 10 days from date of the Board’s hearing with the City Council, c/o City Clerk; 1501 Truxtun Avenue; Bakersfield, CA 93301. Appellants, except those within the public notice area, must include a $675 non-refundable filing fee with the appeal. If all appeals are withdrawn before the City Council’s meeting, they will not hear the item and the Boards decision will become final. = The City will not issue any permit, license or other approval for a use involved in an application until after the appeal period has closed. If the City Clerk does not receive an appeal within the 10- day period, the Board’s decision will become final. 2. PUBLIC STATEMENTS This portion of the meeting is reserved for persons wanting to address the Board on any not on matter this agenda and over which the Board has jurisdiction. Board of Zoning Adjustment Agenda Page 2 Meeting of February 14, 2006. 4. PUBLIC HEARINGS A. CONDITIONAL USE PERMITS 1) FILE NO. 05-1740 – D. R. Horton Los Angeles Holding Co., Inc. (Ward 3) has requested a Conditional Use Permit to allow two 1,440 sq. ft. sales facilities for a 2 year period of time for Tract 6406 in an R-1 (One Family Dwelling) zone district. Staff Recommendation: Approve 2) FILE NO. 06-0072 – Castle & Cooke ? McIntosh & Associates has (Ward 4) requested a Conditional Use Permit for a one year extension of time for an approved Conditional Use Permit (#03-1359) that allowed a temporary sales trailer and temporary parking lot in an R-1 (One-Family Dwelling) zone district located at 10204 and 10302 Hinderhill Drive .
