HomeMy WebLinkAboutRES NO 051-06 RESOLUTION NO. 0 5 1 - 0 6 A RESOLUTION SUPPORTING SENATE BILL 155 (FEINSTEIN) AND HOUSE OF REPRESENTATIVES BILL 970 (SCHIFF) CONCERNING PREVENTION, DETERRENCE AND PUNISHMENT OF GANGS. WHEREAS, over the past years, gang activity has increased across the country; and WHEREAS, gangs have a deleterious effect on urban areas due to the increases in violent and drug-related offenses; and WHEREAS, gangs are looking more to juveniles to assist in carryout out gang activities because the laws applying to juvenile offenders are typically not as onerous as the laws applying to adult offenders; and WHEREAS, gangs are becoming more sophisticated and are crossing state lines to carry out their pattems of intimidation; and WHEREAS, Senator Feinstein and four other senators have drafted Senate Bill 155 (S. 155), known as "The Gang Prevention and Effective Deterrence Act of 2005"; and WHEREAS, S.155 sets forth new federal legislation with stricter penalties for crimes committed by or in furtherance of gangs; and WHEREAS, additionally, S.155 sets forth more instances where juvenile offenders can be tried as adults; and WHEREAS, S.155 appropriates over $100 million dollars to help curb gang activity by way of gang-enforcement teams in high gang activity areas; and WHEREAS, as 8.155 requires appropriations and appropriation bills must initiate in the House of Representatives, there is a related House Bill (H.R. 970) currently being considered in the House of Representatives; and X 'òMf?, o <!;, )0.. - I- m _ r- <.) 0 ORIGINAl WHEREAS, H.R. 970 contains the same language and is titled the same as S.155; and WHEREAS, Bakersfield desires additional mechanisms to deter and prevent gang activity and S.155 and H.R. 970 may offer such help; and WHEREAS, the Safe Neighborhoods and Community Relations Committee supports the passage of 8.155 and H.R. 970 and recommends that the City Council voice its support for the legislation. NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF BAKERSFIELD AS FOLLOWS: 1. The above recitals are true and correct; 2. The City of Bakersfield supports adoption of Senate BiII155 (Feinstein) and House Bill 970 (Schiff) in order to help curb gang activity in Bakersfield and across the country. --------000------- ~M~ ~ ~. >- ~ I;: ,..
