HomeMy WebLinkAboutORD NO 4311 ORDINANCE NO. 4811 AN ORDINANCE AMENDING SECTIONS 17.25.040, 17.25.050, 17.25.080 AND 17.25.090 OF THE BAKERSFIELD MUNICIPAL CODE RELATING TO THE CoB (CENTRAL BUSINESS) ZONE DISTRICT BE IT ORDAINED by the Council of the City of Bakersfield as follows: SECTION 1. Section 17.25,040 is hereby amended to read as follows: 17.25.040 USES PERMITTED ONLY BY CONDITIONAL USE PERMIT. While any use may be permitted by conditional use permit pursuant to Subsection B of Section 17.64.020, the following uses are not permitted in the C-B zone except by conditional use permit issued in accordance with the procedures provided in Chapter 17.64 of this title: A. Any residential use that is located on the irst or ground floor. B. Any of the following uses: 1. Food and/or shelter service agencies as defined in Section 17.04.285. 2. Scientific research and testing services. 3. Swap meets, flea markets and auction houses. SECTION 2. Section 17,25,050 (F) is hereby amended to read as follows: 17.25.050 ADDITIONAL REQUIREMENTS. F. All outside mechanical equipment shall be enclosed or screened from public street view, Bases of towers and antennas shall be screened or enclosed to a height of 15 feet above grade if not camouflaged, SECTION 3. Subsection 5 is hereby added to Section 17,25,080 (6) as follows: 17.25.080 FLOOR AREA RATIO. B. The following areas shall be exempt from the FAR calculation: 5. Subsection 6 is hereby added to Section 17.25.000 (A) to read as follows: 17.25,090 PUBLIC BENEFIT FEATURES. 6. Day care facilities (children and adult). a. Intent. Day care facilities provide a safe and supportive environment for a wide range of educational, social and health related services for both children and adults, Encouraging the integration of these facilities into mixed use developments allow these services to be near both homes and workplaces helping caregivers better manage quality time at both v..ork and home. The location of these facilities near employment centers and residential neighborhoods can also contribute to reducing automobile congestion, air pollution, and enhance the ability to blend civic, volunteer and work interests into sustainable communities. b. Bonus area. The entire area devoted for such use to a maximum floor area of 20,000 square feet. c. The Planning Director must approve CC&R's (Conditions, Covenants and Restrictions), contract, agreement or other such document for the establishment and continued operation for only those day care facilities requesting bonus area as a public benefit feature under the provisions of this chapter. This document shall be recorded to assure that obligations benefiting the building extend to its future owners. SECTION 5. This ordinance shall be posted in accordance with the Bakersfield Municipal Code and shall become effective thirty (30) days from and after the date of its passage. ----------000---------- - 2 - ~ i:>"", () '>ij :>.. :.
