NOTICE OF RIGHT TO APPEAL
Any person may appeal a decision of the Board of Zoning Adjustment. The appeal must be filed in
writing within 10 days from date of the Board’s hearing with the City Council, c/o City Clerk; 1501
Truxtun Avenue; Bakersfield, CA 93301. Appellants, except those within the public notice area,
must include a $675 non-refundable filing fee with the appeal. If all appeals are withdrawn before
the City Council’s meeting, they will not hear the item and the Boards decision will become final.

The City will not issue any permit, license or other approval for a use involved in an application
until after the appeal period has closed. If the City Clerk does not receive an appeal within the 10-
day period, the Board’s decision will become final.

A. CONDITIONAL USE PERMITS
1) File No. 06-0181 -
A Conditional Use Permit to reconstruct,
(Ward 3)
reconfigure, & enlarge classrooms to allow a preschool for 43
children, and a daycare for 15 school age students at an existing
church facility in an R-1 (One-Family Dwelling) zone located at
2906 Loma Linda Drive. The request also includes a reduction of
the building setback along Loma Linda Drive from 25 feet to 10
feet.

2) File No. 06-0192
- Conditional Use Permit to allow the on-site
(Ward 2)
consumption of alcohol at an existing restaurant zoned C-1
(Neighborhood Commercial) located at 1652 Oak Street.
Staff Recommendation: Approve
3) File No. 06-0230 -
A Conditional Use Permit to allow a sober living
(Ward 6)
facility for 12 residents and reduce the required parking from 11
spaces to 8 spaces in an R-1 (One-Family Dwelling) zone district
located at 2309 San Marino Drive.
Staff Recommendation: Approve
B.MODIFICATIONS
1) File No. 06-0164 -
A Modification to reduce the required number of
(Ward 2)
parking spaces from 80 spaces to 76 spaces to permit the
construction of a hot tub at an existing hotel located in a C-2
(Regional Commercial) zone district located at 3600 Chester Lane.

A Modification to reduce the required west
(Ward 4)
setback from 50 feet to 37 feet to permit the construction of two 4-
plex buildings. The properties are in an R-2 (Limited Multi-Family)
zone district located at 13312 & 13313 Rissy Court.
