HomeMy WebLinkAboutRES NO 29-98RESOLUTION NO. ~ 0 ' ~ 8 RESOLUTION MAKING DESIGNATIONS AND APPOINTMENTS TO FULFILL RESPONSIBILITIES AND PERFORM DUTIES CITY OF BAKERSFIELD ASSESSMENT DISTRICT NO. 96-2 (ALLEN ROAD TRUNK SEWER) WHEREAS, the City Council (the "City Council") of the City of Bakersfield (the "City") is considering the formation of an assessment district, pursuant to the City Charter, Chapter 13.08 of the Municipal Code and the Municipal Improvement Act of 1913, being Division 12 (commencing with Section 10000) of the California Streets and Highways Code, for the construction of certain public works and improvements generally described as follows: The construction of improvements consisting of sewer pipelines, including manholes, canal and river crossings, connections to existing sewers and appurtenances thereto and engineering fees within the boundaries of the proposed assessment district and within the public right-of-way or public easement areas, together with incidental costs and costs of issuing assessment bonds all for the benefit of the land within the boundaries of CITY OF BAKERSFIELD ASSESSMENT DISTRICT NO. 96-2 (ALLEN ROAD TRUNK SEWER) (the "Improvements"); WHEREAS, the lands to be specially assessed for the Improvements shall be included within an assessment district designated as CITY OF BAKERSFIELD ASSESSMENT DISTRICT NO. 96-2 (ALLEN ROAD TRUNK SEWER) (the "Assessment District"); WHEREAS, in order to proceed with the formation of the Assessment District it is necessary to make certain designations and appointments to fulfill responsibilities and perform duties of the Assessment District; NOW, THEREFORE, THE CITY COUNCIL HEREBY FINDS, DETERMINES AND RESOLVES as follows: 3/9/98 BAKPKT 1.97~/~ ORIGINAL SECTION 1. The official appointed to assume the responsibilities and perform the duties of Superintendent of Streets and Engineer of Work for the Assessment District shall be Raul M. Rojas, Director of Public Works (the "Engineer of Work"). SECTION 2. The Office of the Engineer of Work, being the Office of the Director of Public Works of the City of Bakersfield, is hereby designated as the place for recordation of the assessment roll and diagram which shall be kept as a permanent record of the Assessment District. SECTION 3. The newspaper designated for all publications for the Assessment District shall be the Bakersfield Californian SECTION 4. The engineer(s) appointed to assume the responsibilities and perform the duties of Assessment Engineer for the Assessment District shall be Boyle Engineering Corporation (the "Assessment Engineer"). SECTION 5. The attorney(s) appointed as Bond Counsel shall be McFarlin & Anderson (the "Bond Counsel"). SECTION 6. The attorney(s) appointed as Disclosure Counsel shall be Arter & Hadden (the "Disclosure Counsel"). SECTION 7.
