HomeMy WebLinkAboutRES NO 076-06 RESOLUTION NO. 0'7 6 - 0 6 A RESOLUTION DISPENSING WITH BIDDING PROCEDURES FOR CONSTRUCTION OF A PERMANENT PUMP STATION FOR WASTEWATER TREATMENT PLANT NO.3, NOT TO EXCEED $8,000,000, DUE TO IMMINENT THREAT TO PUBLIC HEALTH, SAFETY AND WELFARE. WHEREAS, on June, 2002, the Buena Vista Phase II sewer trunk line was completed with major sewer trunk facilities which included a pump station located at the northwest corner of Gosford Road and McCutchen Road; and WHEREAS, the pump station was designed as a temporary facility until such time that nearby Treatment Plant No.3 was expanded and a permanent pump station installed; and WHEREAS, on June 17, 2004, approximately 500,000 gallons of wastewater overflowed the collection system at the corner of McCutchen and Gosford Roads; and WHEREAS, this was the first of several failures which occurred at the temporary pump station causing a spill at the intersection of Buena Vista Road and McCutchen Road, the low point in the system; and WHEREAS, with the tremendous growth the City has experienced in the last few years, the flow greatly outpaced design assumptions made when the temporary pump station was first contemplated; and WHEREAS, the frequency of problems at the temporary pump station has steadily increased to the point where the temporary pump station is monitored 24 hours a day, 7 days a week with the pumps being back-flushed three times a day; and WHEREAS, a recent analysis of the temporary pump station determined it needs to be replaced as soon as possible to protect the health, safety and welfare of the residents of the City; and WHEREAS, expansion for Wastewater Plant No.3 is currently being designed and the designers have been working on the project for over two years; and WHEREAS, if the design and construction of the permanent pump station follows standard design and formal bidding requirements, the new permanent pump station would not be operational for approximately eighteen months; and S:\COUNCIL\Resos\05-06 ResoslEmergency Res pump station.doc Created on 2/24/2006 9:02:00 AM Page 1 of 3 ~~Mf-$' () ¡¡;, >- - \-- rn _ r- Q b ORlr,IM^' WHEREAS, if formal bidding requirements are dispensed with, the new permanent pump station could be operational in approximately seven to eight months; and WHEREAS, to protect the health, safety and welfare of the citizens of the City, the new pump station must be constructed and brought on line as quickly as possible; and WHEREAS, the design engineer's contract will need to be amended to permit the pump station design to be completed on an expedited basis. NOW, THEREFORE, BE IT RESOLVED AS FOLLOWS: 1. The above recitals are true and correct and incorporated herein by reference. 2. City Council hereby determines that based on the above recitals, the work to be performed is of urgent necessity for the preservation of health, safety and welfare, thereby allowing the dispensing of bidding requirements as set forth in Section 136 of the City Charter and Section 3.20.060 of the Bakersfield Municipal Code. 3. The Finance Director is authorized to dispense with bidding in accordance with Section 3.20.060 of the Bakersfield Municipal Code. 4. Staff will return to City Council with an amendment to the design engineer's contract which alters the scope of work regarding the design of the pump station. 5. Staff will make every effort to use competitive guidelines to procure the construction contract. 6. Staff will return to City Council with periodic updates on the status of the pump station design and construction.
