.AN ORDINANCE REGULATING'THE SELLING
VENII NG AND PEDDLING OE ICE CREAM,
ICES AND' OTHER FROZEN DAINTIES, FROM
WAGONS, PUSH CARTS AND VEHICLES
AND PRESCRIBING A PENALTY FOR THE
VIOLATION THEREOF, AND REPEALING
ORDINANCE NO. S30 OF THE CITY OF
BAKERSFiELD, CALIFORNIA..
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF 'BAKEHSFIELD,
as follows:
SECTION 1.
SECTION 2.
It shall. be unlawful for any person, firm or corporation to sell,
vend or'peddle ice cream, ices or other frozen dainties, pop, soda
water or soft drinks from any wagon, push cart o~ vehicle, within
the City of BakerSfield, without'first having procured a permit
as provided for in this Or~ nance. "
Before any person, firm or corporation shall procure a
permit to engage in, or carry on the business of, or perform any
act or acts necessary for the selling, vending or peddling of ice
cream, ices, or other frozen d~inties, in cones cornucopias, or.
otherwise, or for the selling 'rending or peddling of pop, soda water
or soft drinks from any wagon, push cart, or other vehicle, within
the City of Bakersfield, application must be made to the Health
Officer of said City for a permit to do so, and if the said Health
Officer is satisfied'that said wagon, push cart', or vehicle'is pro-
perly screened to protect the contents thereof from flies, with ~;..

can be kept in a clean and sanitary condition, said Health .Officer

will then issue such permit to sell, vend or peddle ice cream,
ices, or ·other frozen dainties and pop, soda water and soft drinks.
SECTION
SECTION 4.
No permit shall be issued for a longer period than ninety
(90) days, and the samAmay be revoked at any ~ime· when such wagon,
push ca~t or other vehicle is not kept, or maintained in a clean.·<
and sanitary condition.
All cones and cornucopias so used sb. all comply with the
rules, re~Alatimns and requirements.of the State Board of Health
of the Starts of Ca~if0rnia and the·rules of the Health Department
of the City of Bakersfield.
SECTION 5.
It shall be unlawful.for any person, firm .or corporation

to sell, vend or peddl'e pop, soda water or other soft drink,. ice
cresm, ices or other frozen dainties. from any. wagon,·push cart or
other vehicle in the City of Bakersfield'within three hundred ~300)'
£Leet from the. exterior boundary of property used and occupied by·a

and operated by the City of Bakersfield, or other public corporations·
SECTION 8.
It shall be unlawful for any person, firm or corporation.
to stop, stan.~ park or cause or permit ·to be stopped, stood or
parked any wagon, push cart or'other' vehicle from which pop, soda·~
water, or other soft drinks, ice cream, ice or other frozen dainties
are sold or peddled within three hundred (300).feet from the exterior
