AN ORDINANCE REGULATING _THE PLAYING
OF .CARDS AND ROLLING OF DICE .kViTHIN
THE CITY OF B~J{ERSFiELD', PROVI. DiNG
A PENALTY FOR THE VIOLATION THER~OF.
BE IT ORDAiNED BY THE COUNCIL OF THE CITY OF BAKERSFIELD.
as follows:
SECTION 1.
That for the purpose of this or'dinance the term "PUBLIC
PLACE" shall be held to mean and inclu.de any place or premises
except a regular meeting place conducted by any fraternal order,
'association or corporation having a state charter, also a bona
fide private dwelling or an apartment, suite or room which is
used in good faith as the residence of one or more persons, in
an apartment house, lodgin~ house, hotel, or other institution
also a
of similar. chara'cter, excepting.:/o~: temporary place conducted by
a f~aternal or benevolent organization who have been granted
permission by the City Council to condu~t a public amusement or
entertainment for fraternal or charitabie purposes.
SECTION 2.
It shall be unlawful for any person to deal, play, or
carry on or open or cause to be opened or con~cted either as
owner or employee or otherwise any g~ne of cards or the rolling·
or playing of dice in any public place as defined herein, in the
City Of Bakersfield.
SECTION 3.
It shall be unlawful for any .person either as owner,
principal, agent, clerk, servant or employee to establish, open,
· keep, maintain or carry on or assist in carrying on in the City
of Bakersfield, the·playing of ·cards or'rolling, shaking or play-

ing of dice in a ~ublic place as defined herein.
It shall be unlawful for any person to become an inmate
of, or visitor at any public place as defined herein where the
playing of cards or the rolling,~haking or playing of dice is
carried on or practised.
SECTION 5.
Any person violating any of the provisions of this ordi-
nance shall be deemed guilty of a misdemeanor, and upon con-
viction shall be punished by a fine of not less than ten '($~0.00)
dollars or more than three hundred ($300.00) dollars or by
imprisonment in the County Jail of Kern County not less than
ten (lO) days or more than ninety (90) days or by both such
fine and imprisonment.
SECTION 6.
If any section, subsection, sentence, clause or phrase
of this Ordinance is for any' reason held to be unconstitutional
or invalid, such decision shall no~ affect the remaining portion
of this Ordinance. ~he City Council hereby declares that it
: would have passed this Ordinance and each section .and subsection
thereof irrespectiv.e of the fact that any one or more Of the
sections, subsections, sentences,'clauses or phrases be'declared
unconstitutional or invalid.
SECTION V.
All ordinances or parts of ordinances in conflict herewith
· are hereby expressly repealed.
I '~EREBY CERTIFY that the foregoing Ordinance was passed
and adopted by the Council of the City of Bakersfield, on the
