AN ORDINANCE REPEALING SE0~ION 41 OF ORDINANCE
NO. 92 NEW SERIES AND. AMENDING SECTIONS 9, 10
AND 40 OF ORDINANCE NO., 92 NEW SERIES AND ADD-
ING NEW SECTIONS TO ORDINANCE N0. 92 NEW SERIES
TO. BE ~0~'~ AS 40 (a), 40 (b), 40 (c), 40 (d).
BE IT 0RDAINED BY THE COUNCIL OF THE CITY OF
BAEERSFI~D, as follows; ..
· SECT,~ON 1.
That Seetlon 9 of Ordinance No. 92 New Series, re-
lating to the regulation and imposing municipal licenses,
presc~ribing how and by whom the licenses shall be obtained, be
and the same is hereby mended to read as follows:
SECTION 9. Every license remaining unpaid at the
close of the 18th ~y after which said license is due, or a
renewal thereof is due, whether monthly, quarterly or annually,
a penalty of ~5% of the amount of said license shall be adde~
thereto and said sum shall be collected and payment thereof
enforced in the same manner as other license fees are collected
and payment thereof is enforced; provided, however, that the
word "paid" shall for the purpose of this section be held to mean
and include the payments being in the office of the license
collector of the License Department of the City of Bakersfield.
And provide~further that in the event the fifteenth day shall
fall upon a legal holiday, then in that event the fifteenth day
shall be ~hcl~tto mean the next b~siness day immediately succeeding
such legal holiday.
SECTION 2.
That Section 10 of the Ordinance No. 92 New Series
"~i'ating to the regulation and i~p~sing m~icipaI lic~nges,
prescribing how and by whom licenses shall be obtained, be and
the same is hereby amended' to read as follows:

SECTION 10. Every person, firm or corporation
receiving a license as provided herein shall post same con-
spicuously in his place of business and all persons or other
persons who have no fixed place of business shall have fastened
or attached to his basket, pack or vehicle and all vehicles
as licensed by this Ordinance upon their receipt of a license
as provided in this Ordinance shall immediately fasten or cause
to be fastened securely a tag' or plate to be furnished by the
License Collector, which tag or plate shall be substantially
as follows:

provided, that every person using a wheeled vehicle shall be.
provided with two such tags or plates which must at all times
be conspicuously fastened or posted, one on either side of
such vehicle used by such person so as such plateS or tagSshall
be plainly distinguishable v~hether such vehicle is in motion or
not; and it is further provided, that said tag no. shall be
in figures, the height of which. shall be at least three (3) inches
and the date of expiration shall be in letters and figures, the
height of which shall be 'at least two inches, and all peddlers
or other persons must produce and show thei~ licenses w?:enever
requested to do so by any person who may make demand to see the
same, and any person, firm or corporation, or peddler who shall
fail and refuse to post or exhibit on demand, as the case may.be,
their respective licenses or tag Nos. as provided herein, shall,
in addition to the penalties hereinafter imposed, have his license
revoked as provided in Section 6 in this Ordinance.
SEC.TION 3.
Section 40 of Ordinance No. 9S New Series relating
to the regulation and imposing municipal licenses, prescribing
how and by whom licenses shall be obtained, be and the same is
hereby mended to .read as follows:
SECTION 40.
For every person, firm or corporation keeping,
owning, operating or rumming any vehicle for the transportation of
freight or other materials for hire, whether the freight or other
materials are.transported or hauled from a point inside the City
Limits of the City of Bakersfield to a point outside said City,
or from a point outside the City Limits of said City to a point of
delivery inside the limits of said city or operating entirely within
the limits of said City the license fee shall.be as follows:
(a) For every horse drawn vehicle having a carrying capacity
of not over 2000 pounds, the sum of ten ($10.00) dollars per year.
(b) For every horse drawn vehicle having a capacity over
2000 pounds and not over 4000 pounds, fourteen ($14.00) dollars per
year.
(c) For every horse d~awn vehicle having a carrying capacity
over 4000 pounds but not more than 6000 pounds, ~tx~e~nl(.$16.O0)
dollars per year.
(d) For every horse drawn vehicle having a carrying capacity
over 6000 but not more than 8000 pounds, twenty ($20.00) dollars
per year.
(e) F,~r every horse drawn vehicle having a capacity over 8000
pounds, thirty ($30.00) dollars per ~year.
(f) For al~ such motor driven vehicles having a carrying
capacity of not over 2000 pounds, ten ($10.00) dollars per year.
(g) For every such motor driven vehicle having a carrying
capacity of over 2000 but not more than 4000 pounds, eighteen ($18.00)
dollars per year.
(h) For every such motor driven vehicle having a carrying
capacity 'Of over 4000 pounds but not more than 6000 pounds, twenty-
two dollars ($~.00) per year.
(i) For every such motor driven vehicle having a carrying
capacity of over 8000 oounds but not ~ver 8000 pounds, the sum of
thirty ($30.00) dollars per year.
(J) For every such motor driven vehicle having a carrying
capacity of SO00 pounds or over, the sum of fifty ($60.00) dollars
per year.
SECTION 4.
That Ordinance No. 92 New Series relating to the
regulation and imposing municipal licenses prescribing how and by
whom licenses shall be obtained, be and the same is hereby mended
by adding new sections thereto ~o be numbered thereon as Section
40 (a),'40 (b), 40 (c) and 40 (d), as follows:
SECTION 40 (a)
Motor driven vehicles for the purpose of this
ordinance shall be held to mean and include any truck,' automobile
or other vehicle driven or propelled by any engine which vehicle
is used for the hauling or transporting or freight or other mater-
ials,:or any trailer or vehicle attached thereto which hauls or
transports freigh~ or other materials therein.
SECTION 40 (b)
The work "Hire" shall for the purposes of this
ordinance be held to mean and include compensation, re~ard or
revenue derived from the hauling.or transporting or freight or
other materials.
SECTION 40 (c)
It shall be unlawful for any ~erson, firm or
corporation to stand, stop or cause to be stood or stopped any
motor ~riven vehicle as defined here~n upon any stmeet, alley or
public thoroughfare within said City, for the purpose of soliciting
or advertising for business of hauling or transporting of
freight or other materials for hire, unless a permit to stand or
stop ~i~..veh!cle.is given and provided.~hat-said pe-rm~t to stand or

stop/shall not ~e granted unless such person,:'firm or corporation
shall pay to the license department of said City the.

license fee of ten dollars ($10.00) per annum.
SEG~TION 40 (d) No license provided for in said Seo:t~o~n 39 and
Sec'tio~ 40 shall be issued for a term less than one year from the
firs t day of the current quarter during which said license is issue~.
SECTION 8.
That Section 41 of 'Ordinance No'. 9B' .New Series
relating to the regulation and imppsing municipal. licenses prescrib-
ing how and b.y wl~om licenses shall be obtained, ~ and the s~ane is
hereby expressl. y repealed.
I' HEREBY CERTIFY that the foreging Ordinance was
