THE PLAYING OF CARDS AND ROLLING OF DICE
'WITHIN THE CiTY OF BAkT6RSFIELD REQUIRING
A PERMIT THEREFOR, MAKING THE VIOLATION
THEREOF A I~ISDEMEANOR AND PROVIDING A
PENALTY THEREFOR, AND REPEALING OREKNANCE
NO. 140 NEW SERIES AND ALL OTHER ORDINANCES
.AND PARTS OF ORDINANCES IN CONFLICT HEREWITH.
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF
BAKERSFIELD, as follows:
SECTION 1.
That for the purpose of this ordinance the term
"Public Place" shall be held to mean and include any place or premises
exc'ept a bonafie~ private dwelling or an apartment house; suite or
room which is used in good faith as a residence of one or more persons
in an apartment house, lodging house, hotel or other institution of
similar character.
SECTS.ON 2.
It shall be unlawful for any person to conduct, carry
on, open or cause to be opened or conducted either as owner, lessee,
agent or employee, or otherwise, any game as defined herein at or
in any public place'as defined herein in the City of Bakersfield with-
out first applying for and receiving from the Council of the City of
Bakersfield a permit to so do.
SECTIO~ 3.
That for the purpose of this ordinance the term
"game" shall be held to mean and include the dealing or playing of
cards, or the rolling,. shaking or playing of dice.
SECTION 4.
Application for' such permit' must be made"on' forms to'
be furnished by the City Clerk of the said City, and which contain
the' following:
(a) The'particular place including the street number of
said establishment, .place or room where. :such game is to be conducted
or carried on.
(b) The name of the owner or owners, or lessee or lessees
where the game is to be carried on at said location; and if any
person other than the' persons above named have charge of, conduct,
or manage said games, the name of said. person who. shall conduct

or manage same, and the e t n of his authority.
(c) Said application mus~ further state that if a permit
be granted t'hereon that said establishment, plac. e, room or premises,
shall be opened for inspection at all times by the Chief of Police
or any regUlarly appointed police officer of said city at any time,
and that all laws of the State of California and ordinances of the
City of Bakersfield relating thereto shall be complied with.
SECTION 8.
Upon receiving such application the Council shall
· refer the same to the Chief of Police for investigation as to the
moral character of the applicant and whether the proposed l~c ation
is a suitable and proper place for conducting the said game, who
shall report thereon at the next regular meeting of said Council.
The said Council shall thereupon, at its discretion, grant or
refuse said permit..
SEC'TIO. N 8.
The permit provided for in this ordinance shall
be granted snd accepted with the expressunderstanding and agreement
that the Council for the City of Bakersfield may revoke the same
at any time if any of the terms or conditions of same have been
violated, or if the same was obtained by fraudulent representations,
or it is shown to the satisfaction of the Council that said game, or
said es~tablishment, place, or room is conducted in an unlawful
manner, or that same is detrimental to the social peace or'public
morals of the community;' provided, however, that the holder of
said permit may appear before the Council in his own behalf, b. ut
the Council shall be the Judge of the sufficiency of the charges,
of what is detrimental to the social peac.e or public morals, and
the decision of said Council thereon shall be conclusive.
~EC!TI0~ V.
Each permit shall be granted and .accepted upon the
further understanding and agreement that all the terms, provisions
and regulations contained in this ordinance, as the same now is
or may hereafter be amended, shall be fully complied with.
SECT~0N 8.
All permits granted hereunder shall be good until
revoked or surrendered; the same shall not be assignable, but
upon the sale or transfer of said business the Council may, upon
application therefor, isaue a new permit to the' purchaser of said
business upon the same terms and conditions that the original
permit was issued.
SECTID~ 9.
If any Section, Subsection, Sentence, Clause or
Phrase of this' Ordinance is held to be unconstitutional or invalid,
such decision shall not effec.t the remaining. portion of this 0rdi-
nanc$. The City Council hereby declares that it w~uld have passe~
this Ordinance and each section and subsee:tion hereof, irrespective
of the fact that any one or more of the sections, subsee.tions, sen-
tences, clauses or phrases be declared unconstitutional and invalid.
SECTION 10.
Any person, firm or corporation violating any of the.
provisions of this ordinance, or failing to comply with any of the
terms-or--reg~latio~ns contained herein-,-o-shall .be
meanor and upon conviction thereof shall be punishable by a fine not
exceeding three hundred ($300.00) dollars or by imprisonment in
the County Jail for a period not exc'eeding ninety (90) d'ays or by
both such fine and imprisonment.
SEC~TION 11.
Ordinance No. 140 NeW Series of the City of Bakers-
field relating to the playing of cards and the rolling and shaking
of dice within the City of Bakersfield be and the same is herel~.y
expressly repealed.
I HEREBY CERTIFY that the foregoing Ordinance was
passed and adfpted by the Council of the City of Bakersfield,
on the3B~day of ~~~~, 1922, by the foilowing vote:
