BE IT ORDAINED BY' THE COUNCIL OF THE CI'iT OF BAKERSFiELD,
as follows:
SECTION i
It shall be unlawful for any person to deal, play or
Garry on or open or cause to be opened, or conduct or cause to
be conducted, either as owner or employee or otherwise, whether
for hire or not, any game not m~ntioned or included in SeCtion
330 or Section 330a of the Penal Code of California, played
with cards, dice or any other device for money, checks, credits,
or 'any other representative of value within the corporate
limits of the City of Bakersfield.
SECTION 2
It shall be unlawful for any person, either as owner,
principal, agent, clerk, ~rvant or employee, tO establish, open,
keep, maintain or carry on or assist in carrying on, in the City
of Bakersfield, any house, room, .or other place, where gambling
is carried.on.
SECTION 3.
It shall be unlawful for any person to become an
in~at~' of,"or a visitor at any gambling house or place where
gambling is practice~ or carried on Within the corporate limits
of the City of Bakersfield.

SECTION 4.
Any house or place in said City of Bakersfield where
any games are played with cards, dice or any other device for money,
checks, chips, credit, or anything of value,.or representative
of value is risked or staked on the issue of any game is hereby
declared to be a nuisance and to be included in the term gambling
~ouse or place, within the meaning of this ordinance.
SECTION 8.
It shall be the duty of the
and each and every police officer of said City to use all legal
means in detecting and convicting persons of violating any provi-
sion of this ordinance, and to exercise the right of search by the
law of this state, and to seize and safely keep all chips, checks,
cards, apparatus and things used for gambling purposes at any place
that may exist contrary to this ordinance in the City of Bakers-
field, and 'to produce the same in court, 'and retain them until
the final decision of any case in which such articles may be
required, as evidence; and said articles shall be destroyed by the
order of the court after proof having been made of their use for
gambling purposes in said City.
SECTION 8.
Any person violating any of the provisions of this
ordinance shall be deemed guilty of a misdemeanor, and upon con-
viction shall be punished by a fine of not less than ten ($10.00)
dollars ~r ~more than three (hundred ($S00.00) dollars, or by
imprisonment in the County Jail of Kern County not less than ten
~10) days or mor. e than ninety days (90), or by both such fine and
imprisonment.

conflict herewith are hereby expressly repealed.
