AN ORDINANCE GRANTING· TO THE ATCHISON, TOPEKA & SANTA FE RAILWAY COMPANY, A- CORPORATION, ITS SUCCESSORS AND ASSIGNS, FOR THE TERM 0R PERIOD OF T~~VE (25) YEARS FROM THE' DAY OF APRIL, 1923, T~E FRANCHISE, RIGHT, PERMISSION AND PRIVILEGE TO LAY, MAINTAIN AND OPER- ATE A SECOND MAIN TRACK OF STANDARD GUAGE RAILROAD TOGETHER WITH THE NECESSARY. CUR.~ES~ SIDE TRACKS, SPURS, SWITCHES, CROSSOVERS AND·APPURTENANCES FOR THE CONVENIENT USE THEREOF, ALONG, UPON AND ACROSS CERTAIN STREETS, POR- TIONS. OF STREETS, AND OTHER PLACES IN THE CITY OF BAKERSFIELD, COUNTY OF KERN, STATE OF CALIFORNIA. BE IT ORDAINED BY THE COUNCIL OF THE CITY ON BAKERSFIELD, as follows: SECTION 1. The Council of the City of Bakersfield, hereby grants, to the Atchison, Topeka & Santa Fe Railway Company, a Corpora- tion, organized and incorporated under the laws of the State of Kansas, its successors and assigns, for the term or periodS. of twenty-five (28) years from the ~3~ day of April, 192~, subject to all the terms, conditions and limita- tions hereinafter made and expressed, the franchise, right and privilege to lay, maintain and operate a second main track'of .standard gauge railroad, together with necessary curves, side .. tracks, spurs, switches, crossovers and appurtenances for the ...... cp.n..venient use thereof, .along, ·upon and-across certain streets., portions of streets and other places in said City of Bakers- field, County of Kern, State of California, more'particularly described as follows: (1) A second main track beginning for its center line at a point fourteen (14) feet north of the center line of 15th Street and sixty-six (66)""feet west of the west line of ... "G" Street, and running thence easterly fou~teen'('i-4:~. feet north from 'and parallel with the center line of 15th Street on a tangent to a point ninety-one ~d one-tenth feet (91.1) more or less, easterly from the easterly line of "P" Street; thence easterly on a curve, concave to the north, having a radius of two thousand eight hundred sixty-four and nine tenths feet (2,864.9) to a point in the northerly line of 18th Street one hundred thirty-eight (138) feet, more or ·less, east measured along said northerly line of lSth Street f~em the east line of "Q"' Street. (2) A second main track beginning for its center line at a point in the center line of 15th Street, ninety-one and one-tenth (91..1) feet, more or less, east of the east line of n.p.,, Street, running thence easterly on a curve, concave northerly, having a radius of .two thousand eight hundred seventy- eight and nine-tenths feeC (~,8V8.9), a distance of four hundred forty-nine and eight-tenths feet (449.8), more or less, to a poiht; thence easterly,. tangent to said curve, across "R" Street to a point on the east line of "R" Street (1~.~5) fifteen and twenty-five hundredths .feet, north of the north line of 15th Street; continuing thence easterly fourteen (14) feet southerly from and parallel with the center line of the present main track, across private property, crossing "S" Street, Union Ave- nue, SonOra Street,' the alley in Block 2S2,' Dolores Street, Inyo Street, Tulare Street, Truxtun Avenue, Eureka Street, Kern SECTION 3. .Street, Baker Street, Fremont Street, King.Street, the alley · in Block 1~8, Beale Avenue,.East 19th Street (formerly Grove · Street), Owens Street, the alley in Block 108, Gage Street, Humboldt Street, Robinson Street, the alley i'n Block and Sumner Street. (3) The extension westerly across Owens Street of two side tracks, the center lines of which are thrity-one (31) feet and forty-four (44)'feet,. respectively, northerly from and parallel to the center line of the present main track. The rights, privileges and permission herein granted to said Corporation are dependent for their continuance and vali;dity upon the performance by said Corporation of all the conditions herOinafter set' forth, to-wit= (1) Said Corporation shall construct suitable culverts for the passage' of water at such points as may be necessary .~on the road'bed of said railroad and shall maint&in the same in p~oper repair. '~ ..... (2) Said Corporation shall keep all of its road bed and tracks, in said Oity in good condition and repair, with proper slopes to enable vehicles to pass and rapass thereon and thereover at all places where crossings shall be maintained and whenever the streets, which cross any 'of the tracks owned by said Octpotation, are paved or repaved said Corporation shall · likewise immediately pave or Pepave said crossings and two feet on the outside of the outermost rails and thereafter keep and maint.ain such crossing and two feet on the outside of the outer- most rails in good condition and repair. I.
