SECTION 1.
SECTION 2.
BE IT ORDAIN'ED BY T'~E COUNCIL OF THE CITY OF BAM~FIELD.,
as follows: .-~ '....
It shall be unlawful for any person, firm or corporation
to keep, maintain, run or conduct any hotel, lodging house, ..
rooming. house or apartment house' in' the City of'Bakersfield,
without first ~:aving procured a permit so to do, from the City
Manager of the City. of Bakersfield, provided however, that the
provisions'of this Ordinance shall not apply to private houses
with permanent tenants as distinguished from transients, in which
· not more than. two rooms or not more than t~o apartments are
rented or leased or held out to be ~ent,ed"or'i'eased.
All applications for permits under the provisions of
this ordinance shall be made out on forms tO be obtained from
the City Manager and shall. in substance contain ~h.e name or
names of the person or persons desiring said. permit,
plac. e where said hotel, lodging house, rooming house or apart-
ment house is t'o be conduct.ed.. Said application when so
fill-ed out shall b!~laced befor-e the'City ~nager of th~ City..
of Bakersfield who shall in his discretion either grant or
refuse such permit and. his decision thereon shall be final and
conclusive.
SECTION 3.

· /'revoke the permit of any person whenever it shall appear to

'permitted to exist, or that acts of lewdness or immorality have
taken place, or is taking place with the knowledge cr means of
knowledge of the proprietor, owner, keeper, manager, or p~'son
in charge, and the decision of the City Council thereon shall
be final and conclusive.
SECTION 4.
Any person, finn or corporation keeping or conducting
an~ hotel, lodging house, rooming house or apartment house
without having first procured a permit, as required by this
Ordi.nance, or who continues to keep or conduct such. hotel or
lodEing house, rooming house or apartment house after such.per-
mit.has~'been revoked, shall be guilty of a misdemeanor, and on
conviction thereof, shall be subject to a fine not exceeding
Three hundred dollars ($300.00) or by imprisonment in the County
Jail of Kern County for a term not exceed'ing'jnin~j~y (90) days,
or both such fine and imprisonment.
And every day that such
hotel, lodginE house, rooming house or apartment house is
conducted in violation of the terms of this Ordinance shall
-be deemed. a s~parate offense.
SECTION' 5.
That Ordinance No. 324 of the City of Bakersfield
regulatifig hotels, lodging, rooming and apartment houses, be and
the same is .her.eby.-expresaly. repealed. -.
SECTION 6.
· If any section, subsection, sentence, 'clause or phrase
of this Ordinance is for any reason held.to be unconstitutional
or invalid, such. decision shall not affect the remaining pot-
tion of this Ordinance.
