It shall be unlawful. for any.person to conduct' or engage .'in the 'occupation of praCtising the profession of palmist, fortune teller', clairvoyant, phrenologist, astrologer or necromancer and .... ~..iving'renumeration'therefor without having first ·'secured a ..~ permit so to do and without first Aecuring a license'to practise " -such oCCupation as herein mentioned~ SECTION 2. That. Or~.nance No. 190 'New Series regulating and imposing'mUnicipal'licenses, be and the same is hereby amended by adding' new sections thereto to be numbered and known as Section 41a, SeCtion 41b, Section 41c, Section 41d and Section 41e, as follows: SECTION 41a~ --- AppliCation for such permit must be made on forms to be furnished by the..Oity Manager of the said City; -1- (1) ...Th.e'partieular ~lace including the street'nUmber-of ~.the place or room .Xhere the OccuPation of prac't~s~ng the'pr~feas- . Upon reCe~i~n.g' such application the C~ty Manager shall refer the same to the-Chief of POlice for investigation as to the · moral character of the app~iC. ant~.and as to whether or not all the '.statements in :th~ application are·true; said Chief of Police shall as soon as'.practical.'file hi-8 report on said application with 'the City' Manager :and the City 'Manager Shall grant'or. refu~e 'said permit. " at his discretion SECTION 41o. EVery person now engaged.in or who may hereafter become engaged in' the occupation of practising the 'professiOn of palmist, ~ortune teller, clairvoyant, phrenologist, astrologer· or necro- mancer and receiving renumeration therefor.shall pay a license fee in the sum of·Five hundre~ dollars ($800.00) per quarter or '~y portion thereO~... " .The-permit'provided for in'.thi~ ordinance shall be granted and accepted wit~ the expreSs'Understanding 'and agreement.that the CounCil of the City of Bakersfield my revoke the same at any time provided,. postage prepaid thereon. -.' if .any of the terms or conditions of the same have been violated, or if.the same was obtained by fraudulent representattonS~ or 'its: is shown to the satisfaction of said Council that said practice of'the profession of palmist,· fortune teller, clairvoyant, phreno!ogist, astrologer or necromancer is'conducted.in an unlawful manner~ or that the same' is' detrimental' to the Social peace or public m~rals of the community; p~ovided however that the holder of: said permi~ m~y ~ppear.befO~elthe'Oouncil in his own behalf at the time~:.fixed by ~he'COuncil to determine whether or not said'permit.'shali be revoked; .the determination 6f' the Council shall.-be cOncluSive as to 'the sufficiency of the' charges placed against 'said'applicant for the revocation of sai~ermit; provided further, that no~ permit shall. be revoked unless. notice shall havW first been g~en at. ~east efore the.hearing thereof. by depositing in the . . .~. ~ .. Unit'ed'~States mail 'a not.ice directed .'to said applicant at.'the address given in the applicantion for a permit'as ~er~l~efore _. SECTION 41e ...... ~ll permits granted hereunder-shall be good until 0~. surrendered; and the 'same .shall not be assignable. "' SECTION 3. If any section, subsection, sentence, clause or'phrase of this Ordinance is held to'.be Unconstitutional or invalid, such -decision shall not affect the remaining portion of this Ordinance, The City Council-hereby'declares that it would have passed this Ordinance, .and eabh section and sUbsection hereof, irrespective .of the'fact that.any one or more $f the sections, subsectiOns., sectences, clauses ~r ·phrases'be decalred unconstitutional and SECTION 4, .. 'All ordinances ,and parts of ordinances in conflict here- Wi~h be and the same are herebyexpressly repealed.
