SECTION 1.
AN ORDINANCE ANENDING SECTION I OF
ORDINANCE N0. 199 NEW SERIES OF THE
CITY OF B~r~ERSFIELD, CALIFO~IA.
BE IT 0RDA~NED BY THE COUNCIL OF THE CITY OF BAKERSFIELD,
as..follows: '
That section l of Ordinance No. 199 New Series.entitled,
"An Ordinance ~egulatin~ the sale of any oil represented as lubricating
oil for the cylinders of internal combustion engines, 'Qr the sale of
gasoline, and providing for the exhibition of.signs, labels and disks
~ndicating the brand or trade name of such lubricating oil and the name
of the manufacturer of such gasoline and prohibiting the filling of
tanks of motor-propelled vehicles while the engines are in operation,
and providing a penalty for the violation of any of the provisions
thereof,:' be and the same is hereby amended to read as follows:
SECTION 1.
It shall be unlawful for any~person, firm or corporation to
sell, offer for sale or delivery, or to cause or permit to be sold,
offered for sale or delivered, in the City of Bakersfield, any oil
represented as lubricating oil for the cylinders of internal combustion
engines, unless there shall be firmly attached or painted, at or near
the point of outlet from which said oil represented as lubricating
oil for the cylinders of internal combustion engines is drawn or poured
out for sale.or delivery, a sign or label consisting of the word or
words, in letters not less than two (~) inches in height, comprising
the brand or trade name of said lubricating oil; provided that when
said sign or label is attached to the faucet or valve of a tank truck
or tank wagon, the letters shall be not less than three-quarters (3/4)
of an inch in height, and provided, that if the above required sign or
label is on a container having a capacity of fifteen (18) gallons, or...
less, the letters shall he not less than one-half (1/2) inch in height,
and provided, that if any of said lubricating oil shall have no brand
or trade name, the above required sign or label shall consist of the
words, in letters not less than three (3) inches high,'with the except-
ions above provided, "LUBRICATING OIL, NO BRAND"; and it shall ~lso
be unlawful for any person, firm or corporation, within the City of
Bakersfield, to sell gasoline from any tank, barrel, drum, or other
movable or Stationary container, unless there is securely fastened,
in a manner plainly visible to any person purchasing such gasoline, a
metal disk, nine (9) inches in diameter bearing in letters not less
than one (1) inch in height the brand or trade name of such gasoline or
the name of the firm manufacturing such gasoline; provided, however,
that in case such gasoline is sold from a pump attached to any such
container such disk shall be securely fastened to said ptunp.
Brand or trade name, within the meaning hereof, 'refers to the name
under which such lubricating oil or 'gasoline is marketed, irrespective
of the firm manufacturing the' same.
I HEREBY CERTIFY that the foregoing Ordinance was passed
and adopted by the Council of the City of Bakersfield on the~3~day
of June, 19~4, by the fol. lOwing vote:
