AN ORDINANCE AbeENDING SECTIONS 10 AND
11 OF 0HDINANCE N0. 127, NEW SERIES,
OF THE CITY OF BAKERSFIELD, CALIFORNIA.
WHEREAS, the immediate .preservation of the public health,
property and safety reauires the passage of'this ordinance;
I~OW THEREFORE, BE IT 0RDAiNED BY THE COUNCIL OF THE CiTY
OF BAIGHSFiELD, as follows:

That sections l0 and ll of Ordinance No. 127 New Series, of
the City of Bakersfield, entitled, "An Ordinance regulating the accU-
mulation, removal, collection and disposal of rubbish, garbage, and
stable manure, and fixing fees and charges for removing the same and
providing a penalty for violation of said ordinance and repealing
Ordinance No. 382 and Ordinance No. 95,New Series and Ordinance No.
96,New Series and all other ordinances and parts of ordinances in
conflict herewith", be and the same is hereby amended to read as follows:
~ SECTION lO. Persons d~siring to collect or haul garbage or rubbish,
ashes or manure as provided in this ordinance shall each year obtain
a written permit from the City Health Officer to do so and no person,
firm or corporation shall remove, collect or haul said garbage, rubbish,
ashes or manure without first procuring such written permit as afore-
said. Such permit shall' be exhibited on demand' of any police officer
or of any person for whom'such person having such permit shall be do-.
ing or shall offer to do such work.
Whenever and during .the ter~n of any contrac~ wherein the
City of Bake~.sfield has contracted for the removal, collection or
hauling of garbage, rubbish, ashes or manure in the City of Bakers-
field, .wi-th.~any person, firm or corporation and the contractor has
furnished a bond for .the faithful performance of the terms of said
,.. contract in an amount fixed and determined by the City Council no
.per~xit for the removal, collection or hauling of garbage, rubbish,
ashes or m~nure in the City of Bakersfield, shall be issued to ahy
other ~erson, firm or corporation, excepting the contracting parties
with the City of Bakersfield.
Any person, firm or corporation holding.~ a permit as provided
herein, upon a violation of any of the provisions of this ordinance
and a conviction thereof~ the s~id City Health Officer may revoke
such permit so issued.
SECTION ll. It shall be unlawful for any .person other than the
owner, or someone authorized by'him or the Health Officer of the
City of Bak. ersf'ield to interfere in any manner with any Such vessel,
tank or receptacle from the location where the same was placed by
the owner thereof, or to remove the contents of any such vessel,
tank or receptacle, provided however, that during any such time as
a contract shall be in force between the City of Bakersfield and
any garbage. or rubbish collector SuCh collector shall remove all
garbage and rubbish from all places where the removal of the same
is not otherwise provided for by the owner or occupant.
SECTION 2.
This ordinance is designated for the immediate preservation
property and'safety
of the public health/and is hereby declared to be an emergency·
measure and shall be in full force and effect imme'diately upon its
passage.
