BE',IT 0RDAINED BY THE COUNCIL OF TEE CITY OF BAKERSFIELD,
as follows:
SECTION 1~
- It shall'· be unlawful for any person, firm or corporation,
as principal, ~gent, officer, clerk or employee, for himself or it-
self or any...other person, firm or ~orporatio.~;.to erect, maintain or
occupy'~ tent, canvas house or movable st.ructure of any kind wh~t-
s..Oever, within the limits of fire districts humbet 1 and number 2 in
the~Oity of Bakersfield, as the same 'are now fixed and may be here-
after fixed withi..n~-the City of Bakersfield, without first securing
a written'.permit from the City Manager of the City of Bakersfield
to se '.~ct, maintain or occupy. Provided that no permit shall be
issued bY said City Manager for a period not to exceed 18 days.
provided, also, that no tent, canvas house or movable structure,
...of any kind, shall be erected, maintained or occupied within the
limits of fire districts number 1 and number 2 as the same are now
fixed....e~. may hereafter be fixed, except that the said ten~, canvas
house. or movable structure be erected, maintained or occupied for
the purpose of holding exhibitions, public speaking, religious gath-
· -Terings. or Chautaugua meetings or other public gatheriags.
SECTTON 2.
Nothing in this ordinance shall be construed to affect,
modify...0r alter in any way, any of the provisions of Ordinance No.
~i90 ~%'w Series of the City of Bakersfield, entitled "An ordinance
whom licenses shall be obtained; making the violation hereof a mis-
demeanor and prescribing a penalty therefor, and repealing Ordinance
Nos. 92 New Series;'ll9 NSw Series, 130 New Series, 1~2 New Series,
1~ New Series, 1~8 New Series and 180 New Series, and all other
ordinances and parts of'ordinances in conflict. herewith,"
or any
of the provisions. of Ordinance No, 15S Mew Series'
Bakersfield,. entitled "An ordinance regulating the com truC~ion, e~ec-
tion, repair, alteration,.demolition, condemnation and.U~e.,~f bU'~ld-
ings in' ~e City of Bakersfield, California, and repe~.~_~rdi~ances
Nos. 1~9, 197, 2V8,. 311, 323, 347, 395 and Ordinance No. 32 New Seri~S
and all ordinances and parts'of ordinances in.conflict herewith."
SECTION 3.
If any section, sub-section, sentence, clause or ph~~£
this ordinance is for any reason held to be unconstitutional or in-
valid, such decision shall not affect the remaining portion of this
ordinance. The City Council hereby declares that it would have passed
this ordinance and each section and sub-section thereof irrespective
of the ~act that any one or more of the sections, sub-sections, sentences,
clauses or phrases be declared unconstitutional or ~nvalid.
SECTION 4.
Any person who shall violate any of the provisions of this
ordinance shall be guilty of a misdemeanor, and on conviction thereof
shall be punished by a fine not to exceed two hundred ($200.00) dollars
or by imprisonment in the County Jail for a period not to exceed ninety
(90) days or by both such fine and imprisonment, and each violation
hereof shall be considered a separate offense.
I HEREBY CERTIFY that the foregoing ordinance was regularly
introduced, passed and adoptedby the Council of the City of Bakers-
field, on'the ~/%day of June, 1926, by the~following vote:
