BE IT 0RDAINED BY THE COUNCIL OF THE CITY oF BAKERSFIELD,
as follows:
SECTION. 1.
That Section 23, Subdivision (b~ of Ordinance No. 190,
New Series, of the City of Bakersfield, passed and adopted by the
Council of the City of Bakersfield on August 20th, 1923, be and
the same .is hereby mended to read as follows:
SECTION 23.
(b} For each and every slot machine, card machine, gun vend-
ing machine, merchandise vending machine, contrivance, appliance
or mechanical ·device, which pays any coin, slug, merchandise or
any representative of value, which are not prohibited by section
330a of the Penal Code of the State of California, where said.
machine, contrivance or appliance herein mentioned is Played by
means of any coin,.having a value in excess of one cent ($.O1),
the sum of Two dollars and fifty cents ($2.80~ per day; and any
appliance, contrivance or machine herelnbefore mentioned which'
is played by means of any coin having a value of. one cent ($.01),
the sum of three'dollars ($3.00) per· year; provided that no
license shall be granted for a period less than one year.
SECTION 2.
It shall be unlawful for any person, firm or corporation
to place or permit'to be placed, kept or maintained or.operated,'
any of the above mentioned contrivances or appliances within a
radius ·of three blocks of any school house or any public school
within the City of Bakersfield.
Any person, firm, or corporation, their agents, or
assigns or lawful representatives keeping, placing, maintaining
or operating, or allowing or permitting said above mentioned
Contrivances or appliances to be placed, kept or maintained'or
operated contrary hereto shall be d~emed guilty of a separate
offense for every day during any portion of which any violation
of any provision of this ordinance is committed or permitted,
and shall be punishable as hereunder contained. ~'
SECTION 4.. '-
Any person, firm or corporation,'violating any'of
the provisions of this ordinance shall be deemed guilty of a
misdemeanor and upon conviction thereof shall be punishable
by a fine of not more than three hundred($300.O0)' dollars, or
by imprisonment in the County Jail for a period not exceeding
ninety days (90) d~ by both such fine and imprisonment.
