BE IT 0RDAIEE~ BY THE COUNCIL 0F THE CITY OF BAKERS-'-
That Section 23, Subdivision (b) of Ordinance No. 288,.
New Series, of the City o~ Bakersfield, passed aad adopted by
the Council of the City of Bakersfield on April 18th, 192V, be and
the same is hereby mmended to read as follows:
SECTION 23.
(b)
For each and every slot machine, card machine, gum
vending machine, merchandise vending machine, contrivance, appli-
ance or mechanical device, which pays any coin, slug, merchandise
or any representative of value, which are not prohibited by Section
330a of the Penal Code of the State of California, the sum of Two
Dollars and Fifty Cents ($2.50) per day; providing'this ordinance
is not intended to apply to any machine or contrivance which pays
n~erchandise of equal value to the coin placed in such machine at
the time of such deposit, or play; and providing also this ordinance
is not intended to and shall not apply to any machine which vends
United States postage stamps. Where said machine',' contrivance or
appliance herein mentioned is played by means of any coin, having
a value of one cent ($.01), the sum of three dollars ($3.00) per
year~ provided that no license shall be granted .for a period less
than one year.
~ECTION 2.
It shall be unlawful for any person, firm or corporat'ion
to place or permit to be placed, kept or maintained or operated,
any of the above mentioned contrivances or applianc~ except stamp,

blocks of any school house or any public school within the City of

SECTION 3.

SECTION 4.
Any person, firm or corporation, violating any of the pro-
visions of this ordinance shall be deemed guilty of a misdemeanor and
upon conviction thereof shall be punishable by a..fine of not more
than three hundred ($300.00) dollars, or by imprisonment in the
County Jail for a period not exceeding ninety (90) days or by both·
such fine and imprisonment.
