AN ORDINANCE PROHIBITING SLOT MACHINES
IN THE CITY OF BAKERSFIELD, AND LICENS-
ING VENDING MACHINES, AND PROVIDING FOR
A PENALTY FOR VIOLATIONS HEREOF.
BE IT 0RDAINED BY THE COUNCIL OF THE CITY OF BAKERSFIELD,
as follows:
SECTION 1. It s~all be unlawful for any person, firm, association,
or corporation to exhibit, use, maintain, operate or permit to be
operated in the City of Bakersfield, at any place, or in any room,
space, tnclosure, or building mmed, leased o.r occupied or under
the control or management of any said person, firm, association or
corporation any slot machine as the same is defined herein, provid-
ed that this shall not be held to mean and include any vending
machine.
SECTION 2. A slot machine for the purpose of this ordinance shall
be held to mean and include any machine, contrivance or device by
the operation of which it pays or delivers, or by any arrangement
entitles the player thereof to checks, chips, slugs, merchandise,
credit, money or things no't of equal value to the coin played therein
or differing in value from the chip, check, slug, money or coin de'
posited therein.
SECTION 3. For the purpose of this ordinance a vending machine shall
be deemed to mean and include any machine, contrivance, devi~e or
appliance which as a result of a deposit of money therein pays only
merchandise, the value of which merchandise corresponds to the value
of the money deposited therein.
SECTION 4. Any person, firm, association or corporation, their agents,
or assigns, or lawful representatives keeping, placing, maintaining
or operating, or allowing or permitting said above mentioned con-
trivances or appliances to be placed, kept or maintained or operated
contr'ary here~o shall be deemed guilty of a separate offense for
every day during any portion of which any violation of any provisions
of this ordinance is committed or permitted, and shall be punishable
as hereunder contained.
~ECTION 5. It shall be unlawful for any person, firm, asso. ciation
or corporation to exhibit, use,-maintain, operate or permit to be
operated in the City of Bakersfield any vendtng machine.· a~.·.defined
herein without first paying a license fee of ~3.00 per year, payable
in advance.
SECTION 8. Any person, firm, association or corporation violating
any of the provisions of this ordinance shall be deemed guilty of
a misdemeanor, and upon conviction thereof shall be punishable by
a fine of not more than five hundred ($500.00) dollars, or by im-
prisonment in the County Jail for a period not exceeding one hundred
and eighty (180) days or by both such fine and imprisonment.
SECTION 7. If any section, sub-section, clause or phrase of this
ordinance is for' any reason held to be unconstitutional such deci-
sion shall not affect the validity of the remaining portions of
this ordinance. The City Council hereby declares that it would have
passed this ordinance, and each section, sub-section, sentence,
clause and phrase thereof, irrespective of the fact that any one or
more other sections, sub-sections, sentences, clauses or phrases be
declared unconstitutional.
