WHEREAS, it is necessary to provide for the public peace, property and safety, N0:,i.~ TI~UEREFORE BE IT ORDAINI_,D BY TIlE COUN3IL OF THE CITY OF B/~KE:~FIEID, ss follows: SECTION 1. BOULEV.~;-RD STOPS. The following streets and parts of streets are hereby de- clared to constitute boulevards for the purpose of this section, to- wit: Chester Avenue from Brunds. ge Lane to 34th Street. Union Avenue from Brundags Lsaae to 34th Street. .C. alifornia Avenue from Oak Street to Baker Street. 18th S_t_r.e_.et from Oak Street to Union Avenue. East 18th Street from Union Avenue to Sonora Street. Fremont Street from Sonora Street to East Truxtt~ Avenue.. East Trux____tun Avenue from Fremont Street to '..jashington Street. Baker Street from California Avenue to Bernard Street. _Niles Street from· Alta Vista Drive to Easterly City Limits. F Street from 19th Street to Califo~.,nia Avenue. Every operator of a vchicle or street car traversing any stroot intersecting any boulev~.rd shall stop such veb. icle or street car at the place where such street meets the nearest property line of the boulevard before entering such boulevard, provided the prop- erty line is clearly marked or signposted as required in this ordin- ance. The City Ivlanager is hereby authorized and required to place and maintain or cause to be placed and maintained ~n the street, ap- propriate signs or devices or marks upon the roadway upon each and every street entering or crossing a boulevard, such signs, devices or marks to bear the word "STOP" or the words "BOULI~,V^.~RD STOP" in such position and with letters of a size to be clearly legible from a distance of fifty (50) feet along the street entering the boule- vard . SEC TION 2. PENAI,TIES Any person violating any of the provisions of this inance, or any rule or regulation made by the City Manager pursuant thereto, shall be guilty of a misdemeanor, and upon conviction thereof shall be punished for the first offense by a fine not to ex- ceed Fifty (.~i~50.00) dollars, or by imprisonment in the County Jail for not more than five (5) days; for a second violation within a period. of one (1) year by a fine not to exceed One Hundred (~il00.O0) Dollars, or by imprisonment in the County Jail for not more than ten ( l0 ) days, or by bot~.~ such fine and imprisorm. ent; for a third and each additional offense committed within one (1) year by a fine not exceeding Five Hundred (.~i~500.00) Dollars, or by imprisonment in the County Jail for a period not to exceed six (8) months, or by both such fine end imprisonment. SECTION 3. DISP0.5ITION OF FINES A~D FORFEITURES. All fines or forfeitures collected upon conviction or upon the forfeiture of bail of any person charged with a violetion of any of the provisions of this ordinance shall be paid into the City Treasury and deposited into a special fund, which is hereby created, to be known as the "Street Improvement Fund". There may be aDDropristed out of said fund such moneys as from time to time may be authorized by the 3ouncil for the purchase and maintenance of traffic signs, signals, lights, and paint msrks necessary to designate the provisions of this ordinance, and the balance of said fund shall be used exclusively in the construction, mainten- ance and improvement of public streets within this city. SECTION 4. EFFECT OF 0HDINANCE. If any section, sub-section, sentence, clause or phrase of this ordinance is for any reason held to be unconstitutional, such decision shall not affect the validity of the remaining porti.o.~s of this ordinance. The City Co~ncil hereby declares that it woui~ have passed this ordinance and. each. section, sub-section, sent~mce, clause and phrase thereof, irrespective of the fact that any one or more sections, sub-sections, sentences, clauses or phrases be declared unconstitutional. SECT I0N 8. REPEAL. Section 19 of Ordinance No. 280 New Series, and Ordin- ance No. 289 New Series of the City of Bakersfield are hereby repealed, and all ordinances or parts of or~linsnces in conflict with or inconsistent with the provisions of this or6inance are hereby repealed, except th~at this repeal shall not affect or prev- ent the prosecution or punishment of any person' for any act done or con~itted in violation of any or:~.inance hereby ropealed prior to the taking effect of this ordinance. SECTION 8. E};~ERGEN~Y ORDINANCE. This ordinance is designated to provide for the public peace, property and safety, and shall become effective at the time of its passage by the Council of the City of B~ersfield. ..... o0o .....
