BE IT 0RDAINED BY THE COUNCIL 0F ~HE CITY OF B~It~'RSFIELD, as follows: CHAPTER I. REGULATIONS AND DUTIES, FALSE ALAR~S AND INTERFERENCE WITH FIRE ALARM SY- STE~. Section 1. During the continuance of a fire the Chief of the Fire Department shall have Police power, and in the blocks in which the fire is established the various police and peace officers of the City of Bakersfield shall execute all orders received from said Chief of the Fire Department, relating to said fire and the extinguishment thereof. Section 2. The Chief of the Fire Department, whenever in his judg- ment it is deemed necessary for the handling of the fire appara- tus or the management and control of a fire, shall have the power to place or cause to be placed, ropes or guards across the streets, alleys and public ways on which shall be situated any building on fire, or to other~ise obstruct or block the streets in the immediate vicinity of said fire, and at such 6ther points as he may deem expedient and necessary, and shall have power to prevent any and all persons not necessary to the handling of said fire apparatus or in the managing and controlling of said fire, except owners or occupants and employes of buildings endangered by the existing fire, from entering within the lines designated by ropes or guards, and -1- excepting also members of the Fire and Police Departments of the City of Bakersfield, and such other persons as said Fire Chief may call to assist in handling said fire apparatus, or to aid in managing and controlling said fire; any person entering within the line or lines designated by ropes and guards and refusing to go outside such lines when directed to do so by said Fire Chief,or any fireman or police officer, shall be guilty of a misdemeanor and upon conviction thereof shall be punished as provided in this Ordinance. Section ~. It shall be unlawful for any driver of any vehicle to drive or cause the same to be driven over any hose while said hose is being used by the Fire Department. Section 4. It shall be unlawful for any person to wilfully or neg- ligently injure any engine house, hose, engine, automobile or other vehicle or any apparatus of the Fire Department of the City of Bakersfield~ Section 5. It shall be unlawful for any person to break, remove or injure any of the wires, parts, appars. tus, or appurtenances of the fire alarm system of the City of Bakersfield, or to disturb or in any manner interfere witch any such wires, parts, apparatus or ap- purtenances; provided, however, that nothing shall be so construed as to make punishable the doing of any of the above mentioned acts with the permission of the Chief' of t~.e Fire Department of said City. Section 6. It shall be unlawful for any person to make or cause to be made, any key or keys thst will lock or unlock any box of the fire alarm system, except under the order and regulations of the Chief of the Fire Department. Section V. It shall be unlawful for any person, firm, or Corporation, their agents or employes to place any wire or wires withi~ 'six (6) feet of any wires used for or connected with the fire alarm system of the City of Bakersfield, unless a written permit there- for be given b;~ the Chief of the Fire Department. Section 8. Whenever it shall be necessary for any person, firm or corporation in the pursuit of a lawful object to remove, inter- fere with or disturb any portion of the wires of the Fire Alarm System, he shall file or cause to be given to the Chief of the Fire Department of the City of Bakersfield a notice thereof; which notice shall be given at least five (5) hours before it shall be necessary to remove, interfere with or disturb any portion of the wires of said Fire Alarm System, and shall state the locality at which, and the manner in which it shall be necessary to remove, interfere with or disturb the same. Section 9. It shall be the duty of any person, firm or corporation taking dovm, disturbing, interfering with or removing any portion of the wires of said Fire Alarm System under the provisions of the preceding section, forthwitch to replace or repair any such wire or wires so taken do~vn, disturbed, interfered with or removed, and to place the same in as good condition 'as the same was before being so taken down or removed, and thereupon report to the Chief of the Fire Department that said work has been done. Section 10. It shall be the duty of any person, firm or corporation, their agents or employees opening or disturbing the surface of any public street within the City of Bakersfield, or causing same to be opened or disturbed, or ~vho for any reason places or causes to be placed any barrier or obstruction thereon, which would in any way impede or endanger t~oe speed or progress of any fire ap- -3- paratus on its way to respond to an alarm of fire, to at once notify the Chief of. the Fire Department of such opening or dis- tu~bance of such street or of any barrier thereon giving the exact location of same, the Fire Chief shall thereupon cause notice to be conspicuously posted in each fire house for the information of the drivers of all such fire apparatus. It shall be the further duty of said person, firm or corporation to notify the Fire Chief when the surface of said street is age. in restored to its former condition and any barrier thereon has been removed. Section ll. It .shall be the duty of any person, firm or corporation supplying water to the City of Bakersfield and its inhabitants through hydrants located upon streets, alleys or public places within the City of Bakers field, whenever by reason of repairs or Work, or from any cause the water is turned off from any such hy- drants, to notify the Fire Department of said City thereof, before the water is turned off, and 'the length of time such hydrant will remain without water. And in case of sn alarm of fire in the City, it shall be the duty of such person, firm or corporation to turn into all the mains and hydrants all the water necessary or available if possible. Section 12. -- In case such person or corporation be engaged in work upon any line of pipe necessitating the turni~g off of water, no such line of pipe shall be left open or empty during the night, or when work is not actually going on therein, and if any line of pipe be open at the time of quitting work, or when an alarm of fire is given a cap or thimble shall immediately be placed closely over the mouth of such pipe and the water left in as far as possible for the use of the Fire Department. Any person, superintendent, foreman or agent having charge or control of any such pipe or hydrants, in doing or ordering work done in or -4- upon the same, who shall violate any provision of this section shall be guilty of a misdemeanor, and upon conviction thereof shall be fined not less than ten ($10.00) dollars nor more than three hundred ($300.00) dollars. Section 13. It shall be unlawful for any person, firm or corporation, their agents, or employees, having under their control any lot or premises to permit or allow water to flow upon said lot or premises from any hose, hydrant or pipe connected with any water system supplying water to the City of Bakers field and the inhabitants thereof, during the prevalence of any fire, after an alarm shall have been given or they have knowledge of said fire, except where such water is used to extinguish said fire. Section 14. It shall be unlawful for any person to open or use or cause to be opened and used any fire hydrants within the City of Bakersfield except such person or persons as may be thereunto authorized and directed by the Chief of the Fire Department of said City of Bakersfield. Section 15. It shall be unlawful for any person to knowingly send, give, transmit or sound any false alarm of fire by means of any fire alarm system or signal or through any telephone within the City of Bakersfield. Section 18. (a) The term "C0~USTIBLE RUBBISH" shall include and mean paper, pasteboard, carpets, rags, clothing, books, boots, shoes, straw, packing, barrels, boxes, oily rags, oily waste, furniture, sawdust, shavings and other similar articles that will cinerate through contact with flames of ordinary temperature. (b) The term "ASHES" shall include and mean the residue of materials burned. Section 1V. It shall be unlawful for any pe~°.son, firm or corporation -5- to deposit, keep, accumulate or permit, cause or suffer any com- bustible rubbish or waste matter to be deposited, kept or ac- cumulated upon any lot or parcel of land, or on any public or pri- vate place, street, lane, alley or drive unless the same shall be kept deposited or allowed to accumulate in a metal receptacle pro- vided with a handle or handles and said receptacle shall not have a larger cap~city than fifty (50) gallons, said receptacle to be provided with a close fitting metal lid or cover which shall be kept closed at all times except when necessarily opened to permit rubbish or waste matter to be taken therefrom or deposited therein. Provided., however, receptacles containing ashes shall have a capacity of not less than three (3) gallons and not more than fif- teen (15) gallons, and nothing but ashes shall be placed therein. ~ Provided, further, that it shall be Lbnlawful for any person, firm or corporation to keep, accumulate or permit to be kept or accumu- lated any oily rags or oily waste, except when in actual use, in any building, or inclosure unless the same be kept in a metal re- ceptacle or can fitted with a self closing lid or cover, said re- ceptacle being of durable material, having riveted joints, stand- ing on metal legs, which raise the bottom of the receptacle or container at least five (5) inches above the floor. Section 18. No person or persons shall allow to remain overnight in any alley, or on any sidewalk or premises, within thirty feet of any building in the City of Bakersfield, empty boxes, barrels, rubbish, trash, waste paper, excelsior or other like combustible materials. Section 19. It shall be ~mlawful for any person or persons to burn straw, lumber, trast~,, rubbish, leaves or other co~tustible material in any street, alley, vacant lot or pro-raises within the fire limits of the City of Bakersfield as prescribed by Ordinance No 304,New ~ · Series~ or any amendments thereto. -8- Section 20. " I t shall be unlawful for any person or persons to burn straw, lumber, trash, rubbish, leaves or other com~..~.~_~'~' ible material on any lot or premises outside the prescribed fire limits of the City of Bakersfield, except between the hours of sunrise and 12 noon, and no such combustible material shall be burned within thirty feet of any fence or building; and no such combustible ~.aterial shall be burned except when reasonable precautions shall be taken to prevent the spread of such fire. Section It shall be unlawful for the o~er, agent, lessee, manager or other person'or persons in charge of any theatre, church, lecture hall 'or other place of public assemblage to allow to be placed in any aisle or passageway of such theatre, church, lexture hall or other place of public assemblage, any chair, camp stool or other obstruction while such theatre, church, lecture hall er other place of public assemblage is open to the public. It shall be unlawful for any person, except a police- man, fireman or employee of theatre, to remain standing in any aisle, passageway or s tairv~ay of any theatre while such theatre is open to the public. Section 22 . It shall be unlawful for any person to smoke a pipe, cigar, or cigarette or to light or strike any match or other open light in any theatre, except open air theotres. Section In all cases where there are gratings or slatted openings in the sidewalk, or over any opening leading into the basement of a building, a wire netting of not over one- half inch mesh shall be placed beneath such grating or slats so as to prevent rubbish from falling through. -V- Section All arc lights or incandescent lights in show windows shall be covered with globes or reflectors. No goods of any kind or description shall be displayed, placed, hung or sus- pended within six (6) inches of any such globe or reflectors used as a covering for any arc light or incandescent light in show windows. Section It shall be the duty of the Chief of the Fire Department of the City of Bakersfield, to ins~ect at least once every month all basements, store-rooms, garages, machine-shops, paint shops, and passage ways, within the City of Bakersfield, and all lots or vacant spaces surrounding or adjoining same, within the fire limits or without the firelimits if he deems it necessary, to see that same is being used and kept in such a manner as not to be a fire menace and that no rubbish, waste, oily rags, or other combustible matter is allowed to accumulate therein or thereon, unless same is properly stored with every precaution to prevent the spread of fire; such inspection to carry with it full police power to compel the owner or person in charge thereof to clean out and make such charges in, on or about said premises as public safety may demand. Section Whenever any officer or any member of the Fire Department shall find in any building, or upon any premises or other place, combustible or explosive matter or dangerous accumulation of rubbish or unnecessary accumulation of waste paper, boxes, shav- ings, or any other inflammable materials especially liable to fire, and which is so situated as to endanger property, or shall find obstructions to or on fire escapes, stairs, passagev~ays, basement entrances, doors, or windows, liable to interfere with the operations of the Fire Department, or egress of occupants, in case of fire he shall order the same to be removed, and such -8- (Section ~6. ) order shall be complied with by the ovmer or occupant of such build- ings or premises within forty-eight (48) hours from service of notice. The service of any such order shall be made upon the ovmer or occupant of any such premises to whom it is directed by either delivering a true copy of same to such owner or occupant personally or by delivering the same to and leaving it with any person in charge of the premises, or in case no such person is found upon the premises by affixing a true copy thereof in a conspicuous place on the door to the entrance of said premises. V~enever such owner or occupant shall be absent from the jurisdiction of the officer making the order, notice shall be served on such o~mer or occupant by mailing a true copy of such order to the last known postoffice address of such owner or occu- pant. Section ~V. It shall be the duty of any person, firm~ or corporation, their agents or employes, maintaining a telephone system within the City of Bakersfield, for the purpose of furnishing telephone service to the inhabitants of said City, whenever the said teleohone service extends to a~d is connected with the fire houses of the City of Bakersfield, and the said telephone service to any one of said fire houses is cut off, interfered with or for any reason whatever if ten~porarily discontinued, to at once notify the Chief of the Fire Department of the City of Bakers field as well as all other fire houses belonging to said City, of said cut-off, interfered with and discontinued telephone service to said fire house, and to thereupon proceed to restore said service with as little delay ss possible and when said telephone service is again restored to notify said Fire Chief to that effect. Section The Chief of the Fire Department and subordinate officers of the Fire Department, Chief of Police and all police officers of the City of Bakersfield are directed to' see that the provisions of this ordinance are in force and to that end are hereby empowered whenever any complaint shall be made to them, or either o~ them of the violation of any of the provisions of this ordinance, and they or either of them have reasonable grounds to believe that any of the provisions of this ordinance are being violated by any person, to enter upon any premises or place, o~.~ go into any build- ing about wThich complaint is made, or uDon or in which they or either of them have reasonable grounds to believe that any of the provisions of this ordinance are being violated. CHAPTER II. STORAGE TANKS, PIPES AND OTHER APPURTENANCES Section 1. Upon the written request addressed to the Chief of the Fire Department of the City of Bakersfield, of any reliable per- son, firm or corporation or its duly authorized agents, accompanied with plans and specifications of such proposed storage tanks con- taining any gasoline, naptha, kerosene or other °~ flannnable liquid, piping or other appurtenances, and upon the recommendation of the Chief of the Fire Dopsrtment of t~-e City of Bakersfield it shall be lawful for such person, firm or corporation to obtain a permit to construct such storage tanks, pipes and other appurtenances as hereinafter provided for. Section B. It shall be unlawful for any person, firm or corporation, their agents, representatives, employes or assigns, to keep, build, construct or permit to be kept, built or constructed, any storage tank containing any gasoline, naptha, kerosene or other flammable li~.uid except that it be 'in accordance with the "Reg~tlations of the National Board of Fire Underwriters for the Installation of Containers for Storing and Handling Flammable Liquids", Edition' of 192V, and all subsequent editions and amendments thereto; also to be in accordance with the regulations as found in the "Suggested Ordinance Regulat- ing th~ Use, Handling, Storago and Sale of Fls~,~nsble Liq.uids and the. products thereof", adopted by the National FiPe Protection As- -10- sociation in 1929, and all subsequent amendments theretO; also to be in accordance with the "Regulations of the National Board of Fire Underwriters for the Construction and Installation of 0il Burning Equipments and for the Storage and Use of Fuel 0ils in Connection Therewith", edition of 1925 and as recommended .by the National Fire Protection 'Association. CHAP TER III. Section 1. On and after the date of the adoption of this ordinance it shall be unlawful for any person, firm or corporation, their agents, representatives, employees or assigns to build, construct or install any pump or other device for the delivery of any flam- able liquid unless the same be built, constructed or installed entire- ly within private property. CHAPTER IV. CONSTITUTIONALITY, PENALTIES ~D REPEALING 0RD ~NANCES. Section 1. If any section, subsection, sentence, clause or phrase of this ordinance iS for any reason held to be unconstitutional or invalid, such decision shall not affect the remaining portion of this ordinance. The City Gouncil hereby declares that it would have passed this ordinance and each section and subsection thereof irrespective of the fact that any one or more of the sections, sub- sections, sentences, clauses or phrases be declared unconstitutional or invalid. Section 2. Any person, firm or corporation violating any of the pro- visions of this ordinance shall be deemed guilty of a misdemeanor, and upon conviction thereof shall be punished by a fine not to ex- ceed three hundred ($300.00) dollars or by imprisonment in the County Jail not ex-ceeding ninety (90) days or by both such fine and imprisonment. Section 3. That Ordinance No. 131, Ordinance No. ~41, and Ordinance 508, New Series, relating to the Fire Department and all' other ordinances and parts of ordinances of the City of Bakersfield in conflict herewith be and the same are hereby expressly re- pealed. ...... o0o .....
