HomeMy WebLinkAboutORD NO 335ORDINANCE NO. DD~' NEW SERIES AN ORDINANCE ~ENDING SECTIONS 2 and 5 of ORDINANCE N0. 127 NEW SERIES (F THE CITY OF BAKERS- FIELD, CALIFORNIA. as fQllows: SECTION 1. BE IT 0RDAINED BY ~HE COUNCIL OF THE CITY OF BAKERSFIELD, That Sections 2 and 5 of Ordinance No. 12V New Series of the City of Bakersfield, entitled "AN ORDINANCE REGULATING THE ACCUMULATION, REMOVAL, COLLECTION AND DISPOSAL OF RUBBISH, GARGAGE AND STABLE MANURE, AND FIXING FEES AND CHARGES FOR REMOVING THE SAME.. AND PROVIDING A PENALTY FOR VIOLATION OF SAID ORDINANCE AND REPEALING ORDINANCE NO. 582 and ORDINANCE NO. 95 NEW SERIES, AND ALL OTHER ORDINANCES AND PARTS OF ORDINANCES IN CONFLICT HEREWITH" be and the same are hereby amended to read as follows: SECTION 2. (a) For the purpose of this ordinance the word "GARBAGE" shall be held to include and mean kitchen and table refuse and offal, swill, and also every accumulation of animal, vegetable and other matter that attends the preparation, consumption, decay or dealing in or storage of meats, fish, fowls, birds, fruits or vegetables (saving and excepting that dead animals and offal of slaughter houses are not included within the meaning of said word "garbage" as herein defined. ) (b) The term "NIGHT SOIL" shall be held to include and mean the contents of privy vaults, cess pools, dry wells and sinks. (c) For the purpose of this ordinance, the word "RUBBISH" shall mean and include all combustible and non-combustible waste and refuse matter, excepting garbage, ordinarily accumulating in and about residences, flats, buildings, apartment houses, lodging houses, hotels, restaurants, eating houses, stores, shops, offices and other '~ldings, and among other things it shall include tree trimmings, grass cuttings and dead plants and weeds, but shall not include brick mortar or other debris incident to the construction or demolitio~ of buildings. 1. The tex~ "NON-COMBUSTIBEL RUBBISH" shall incl~e and be held ~ mean broken crockex~J, broken bottles, broken brick, tin vessels, trin~nings from lawns and flower gardens, ashes, Wee trin~nings, natural soil, street sweepings, earth and stone, obsolete or abandoned motor vehicles, an~ non-combustible waste matter. 2. The term "COMBUSTIBLE RUBBISH"' shall include and mean paper, pasteboard, carpets, rags, clothing, books, boots, shoes, straw, packing, barrels, boxes, oily rags, oil waste, furniture, sawdust, shavings and other similar articles that will cinerate through contract with flames of ordinary temperature. (d) The term "ASHES" shall be held to include and r~ean the residue of materials burned. (e) ' The term "COLLECTOR" shall mean for the purposes of this ordinance, any person or persc~s, firm or firms, corporation or corporations, who make a business of going from house to house, from place to place collecting garbage and rubbish in the City of Bakers fie ld. ~f) The term "PERMITTEE" for the purpose of this ord- inance shall be held to mean and include any person, firm or cor- poration who has been grsnted a permit for the removal of garbage or rubbish as provided in this ordinance. SECTION 6. It shall be unlawful for any person, firm or corporation to keep, accumulate or permit to be kept or accumulated any non- combustible rubbish as defined here in unless the same be kept in a suitable box or boxes, barrels or other proper receptacles to be kept on each of said premises sufficient to hold the non-combustible rubbish which would ordinarily acc~nnulate on such premises, unless the same be kept in a regular established permanent and fixed place of business for which a permit has been issued and a license procured for maintaining such business.
