OF THE E~PLOYEES OF T~[E CITY OF BAEEi~SFIEID, RELATING TO IN- JURIES SUST~,II~BD BY ER~LOYEES IN THE COURSE OF TP. EIR Er,~PLOYMENT, A~[D TO PROVIDE COMPENSA- TION THEMEFOR, IN ADDITION TO THAT PROVIDED BY ~HE WORt~EN 'S '~OB"PENSATION INSURANCE AND SAFETY ACT, AND REPEALING ALL ORDINANCES AND PARTS OF ORDINANCES IN CONFLICT HEREWITH. BE IT ORDAIN1,.~D BY THE COUNCIL OF THE CI.qY OF BAtGE~SFIELD, as follows: SECTION 1. An employee shall be defined to mean and include any person who has been employed to work for the City of Bakersfield on a salary or daily wages, and who has not resigned or who has not been discharged from such service either before or after the injury. hereinafter mentioned. SEC TI ON 2. If' andwhen an employee shall have received compensation by an award of the Industrial Accident Commission of the State of California, or shall receive compensation from the Insurance Fund of the State of ~slifornia for any injury he has sustained while in the course of his emplo.Vment by the City of Bakersfield, such employee may make application to the City Manager on forms nro- vided by the City of Bakersfield, for additional compensation, payable by said City under the schedule as follows: For the 1st month full salary less the amount paid by the Insurance Fund of the State of California. For the 2n~ month an amount which shall equal 90% of the difference between his monthly salary and the amount allowed by the Insurance Fund of the State of California. For the 3rd month an amount which shall equal 80% of the difference between his monthly salary and the amount allowed by the Insurance Fund of the State of California. For the 4th month an amount which shall equal 70% of the difference between his monthly salary and the amount allowed by the Insurance Fund of the State of California. - For the 5th month an a~.nount which shall equal 60% of the difference between his monthly salary and the am. ount allowed by the Insurance Fund of the .State of California. For the 8th month an amount which shall eaual 50% of the difference between his monthly salary and the amount allowed by the Insurance Fund of the State of California'. For the 7th month an amount which shall eeual 40% of the difference between his monthly salary and the amount allowed by the Insurance Fund of the State of California. For the 8th month an amount which shall eoual 30% of the difference between his monthly salary and the amount allowed by the Insurance Fund of the St~te of California. For the 9th month an amount which shall ecual 20% of the difference between his monthly salary and .the amount allowed by the Insurance Fund of the S,,ate of C~lifornia. For the lOth month an amount which shall e~ual 10% of the difference between his monthly salary and the amoont allowed by the Insurance Fund of the State of California. After the lOth monthly payment no extra compensation shall be allowed by the City of Bakersfield. Said payments to be made only upon the application of the employee and approved by the City E~anager, and to continue as per said schedule, provided, however, that in case the City Manager refuses to approve any application for additional com- pensation, then the employee making said appli.~.ation may appeal to the Council, and its findings shall be final and conclusive, and provided, further, that the City Council may at any time discontinue payments as per said schedule or otherwise, when in its opinion said payments should stop, and provided further that in no case shall said payments be continued after death of said employee or after pa.Vments shall have ceased by said Insurance. Fund of the State of California. And provided further that there shall be deducted from the amount paid under the foregoing schedule any sum that may become due and payable to said employee from any City pension t~d during the tinge that said employee is claiming e~tra corn- pensation. SECTION 3. Upon the filing and allowance of any claim as above provided, the Auditor of the City of Bakersfield shall draw his warrant upon the Treasurer of the ~ity of Bakers field each successive month as the same shall become due and payable, and the Treasurer of the City of Bakersfield shall, upon Dresenta- tion of said warrant, pay the same out of the fund of the City of Bakersfield from which the salary of the injured employee has formerly been' paid. SECTION 4. It shall be khe duty of my employee claiming compensa- tion hereunder to notify the City Manager and the Auditor of the City of Bakers field immediately upon the termination by the Insurance Fund of the State of California, or otherwise, of his compensation for such injuries. SECTI ON 5. All ordinances or parts of ordinances in conflict here- with are hereby expressly repealed. ..... o0o ......
