OBLIGATIONS OF BAKERSFIELD AND KERN ELECTRIC
RAILWAY COMPANY UPON ABANDONE~.NT OF TWO STI~EET
RAILWAY LINES IN THE CITY OF B~xwE. RSFIELD.
W~n~REAS~ Bakersfield and Kern Electric Railway
Company has filed an application with this Council for the
adoption of an emergency ordinance fixing and defining the
obligation of said Railway Company upon the abandonment of
that certain line of railway on Chester Avenue from the
intersection thereof with 19th Street north to the end
thereof at the Southern Pacific railroad tracks and that
certain other line of street railway on 19th Street from
the intersection thereof with F. Street west to Oak Street,
and
WHEREAS, in said application said Railway Company
has declared its intention to abandon said two lines of
railway upon obtaining the approval thereof by the Railroad
Commission of the State of California, and
WHEREAS, it appears to be to the benef&t of the
City of Bakersfield that' the foundation upon which the rails
and tracks of said two lines of railway to be abandoned are
laid is of such materials and of such dimensions that it
affords a better support than the foundation laid under the
balance of the pavement of said streets and that the roadbed,
tracks and rails of said two lines of railway should remain
as installed and be covered with a material of a dimension to
be specified by the City Enginer of the City of Bakersfield
and that when so covered, the streets where such tracks
are now located will be in a satisfactory condition, and
WHEB~AS, the said City Engineer reported the result
of his investigation of the method necessary to be used in
covering such rails ~nd of the estimate of the cost of
materials and labor in connection with such work and
that such estimate as made by him is the sum of $4504.00, and
WHEBEAS, an emergency exists involving the public
property and safety of the people of the City of Bakersfield,
NOW THEBEFORE, BE IT OBDAINED by the City Council
of the City of Bakersfield as follows:
SECTION N0. 1 That Bakersfield and Kern Electric
Railway Company shall, upon the abandonment of that certain
line of railway on Chester Avenue from the Intersection
thereof with 19th Street north to the end thereof at the
Southern Pacific railroad tracks and that certain other line
of street railway on 19th Street from the intersection there-
of with F. Street west to Oak Street, at its own cost snd
expense, remove from the streets of the City of Bakersfield
all poles, wires and overhead trolley system used in connec-
tionwith the operation of said two lines of railway to be
abandoned and that said Railway Company shall fUrther pay to
the City Treasurer of the City of Bakersfield the estimated
-cost of covering the rails of the tracks of said two lines
of railway to be abandoned with such materials and to such
extent as may be required and specified by the City Engineer
of the City of Bakersfield, which sum is fixed to be $4504.00.
SECTION NO. 2. This ordinance is hereby declared
to be an emergency measure within the meaning of Section 24
of the Charter of the City of Bakersfield, State of
California, necessary for the immediate preservation of
the public property and safety and shall take effect imme-
diately.
I hereby certify that the foregoing emergency
ordinance was passed and adopted by the Council of the City
of Bakersfield on the 12th day of June, 19~, by the following
