SERIES OF THE CITY OF BAtGERSFIELD BY AZ~ENDING SECTIONS 4, 5 and 8, THERE- OF, RELATING TO THE EXTENSION OF INTERIM ZONE DISTRICT NUMBER ONE OF THE CITY OF BAKERSFIELD, DECLARING THE EERERGENCY OF THIS 0EDIN* ANCE AND PROVIDING TPAT IT SHALL TAKE EFFECT IMMEDIATELY.' ~HEREAS, the health, safety and welfare of the inhabitants of the City of Bakersfield require the passage of an emergency ordin- ance providing for the extension of Interim Zone District Number One of said City, NOW THEREFORE BE IT ORDAINED by the Council of the City of Bakersfield, as follows: SECTION 1 Section 4 of Ordinance No. 429, New Series, of the City of Bakersfield, is hereby mended to read as follows, to wit: SECTION ~ Interim Zone District Number'One of the City of Bak- ersfield is hereby established, consisting of all that property lying within a distance of one hundred fifty (150) feet from the exterior boundaries of Golden State Avenue within said City, and all that property lying within a distance of one .hundred fifty (150) feet from the exterior boundaries of that portion of Union Avenue within the said City of Bakersfield between its intersection with Golden State Avenue and Brundage Lane, and consisting further of all that property lying within a distance of one hundred fifty feet (150) from the exterior boundaries of the Traffic Circle situated at the intersection of said Golden State Avenue and Chester Avenue. SECTION 2 Section 5 of said Ordinance is hereby mended to read as follows: SECTION 5 No building, structure or other improvement shall hereafter be erected or constructed within a distance of sixty-five (85) feet from the center line of Golden State Avenue and Union Avenue within the boundaries of Interim Zone District Number One, and in addition within a distance of ten (10) feet from the ex- terior boundaries of the Traffic Circle situated at the intersection of Golden State Avenue and Chester Avenue; provided, that the re- quirements of this Section shal3. not apply to front yard and farm fences, sprinkling structures and appurtenances thereto, walks, curbs, driveways and roadways, and structures and improvements not higher than the surface of the ground. SECTION 3 Section 6 of said 0r~inance is hereby mended to read as follows, to-wit: SECTION 8 Each application for any permit to erect, construct, alter, convert, repair or move any building, structure or other improvement in said Interim Zone District Number One of the City of Bakersfield or within a distance of one hundred fifty (180) feet from the exterior boundaries of Union Avenue between the in- tersection thereof with Golden State Avenue and the northerly boun- dary of said City, shall be accompanied by drawings or sketches showing the front, sides and rear elevations of the proposed build- ing, structure or other improvement or of the building, structure or other improvement as the same will appear after the work for which the permit is sought has been completed. The City Planning Commission shall consider such drawings or sketches to the end that such buildings, structures and other improvements shall be so designed and constructed that they will not be of unsightly, undesirable or obnoxious appearance, or hinder the orderly and harmonious development of Bakersfield, or impair the desirability of residence, investment, occupation or recreation in Bakersfield as appearing to travelers passing through, or limit the opportunity to attain the maximum use and development of lends and improvements, and/or otherwise adversely affect the general prosperity and wel- fare, and to the end that the appearance of buildings, structures and other improvements adjacent to Golden State Avenue and to Union Avenue within the City, shall provide a pleasant, attractive and worthy approach and entrance ~nd exit to the City. For these pur- poses the City Planning Commission shall suggest any changes in the plans of such buildings, structures and other improvements as it may deem to be necessary to accomplish the purposes of this section, and shell not approve any such plans until it is satisfied thet such purposes will be accomplished. The City Planning Connnission shall act on such matter at the earliest possible time and not later than its first meeting five days after such drawings and sketches have been filed; end in case the applicant is not satis- fied with the action of the City Planning Comm. ission, said applicant may, within thirty (30) days after such action, appeal in writing to the C~ty Council. Said Cit3T Council shall hold a hearing on said appeal at its next regular meeting after such appeal hes been taken and in any 3rse shall rsr~der its docicioa on said appeal with- in sixty (60) days after the filing thereof. No permit coming under the provisions of this section shall be issued unless the plans filed therewith as reouired in this section shall first have been approved by the City Planning Oomn, is slon or by the Oiby Council, as provided herein. Every drawing or sketch filed under the provisions of this section shall become a part of the permanent records of the City Planning Commission. SECTION 4 This ordinance is hereby declared to be an emergency ordinance within the meening of Section 24 of the Charter of t~ City of Bak- ersfield, State of California, and necessary for the immediate per- servation of the public health, peace, property ~xd safety a.~i shall take effect iz~nediately. The facts constituting such emergency are as follows: Golden State Avenue and Union Avenue between its intersection with Golden State Avenue and the southerly boundary of said City to- gether with the Traffic Ci:~cle at the intersection of Golden State Avenue and Chester Avenue constitute the principle State Highway route through the city of Bakersfield and large volumes of traffic are now carried by said route. In order to protect traffic move- ments on said ~.ol~te, in order to provide s. safe and pleasant tho- roughfare for travel~the City and in order to prevent discrimina- tion amoU~g verious properties along said route, it is necessary that the re,elations prescribed for Interim Zone District Number One of the City of Ba~_ersfield as set forth in Ordinance Number 429, N.S. shall be extended tO all property adjacent to said route. Due to the recent completion of connecting Highway links which make Golden. State Avenue an integral part of California State Highway route Number Four and because of considerable building activity within the City of Bakersrield, numerous applications are being made for building permits along those portions of Golden State Avenue and of Union Avenue between its intersection with Golden State Avenue and the southerly boundaries of said City which, under the terms of said Ordinance No. 429 New Series are not included within said Interim Zone District Number One to the extent that large and extensive improvements may be made regardless of the provisions of this ordinance. ..... o0o .....
