COUNCIL 0F THE CITY OF BAEE~SFIELD, The words "Transient Photographer" and "Transient Photo Finisher" as used in this ordinance shall be deemed to mean and 'include each person, whether acting as principal, agent or employee, 'who engages in the business of doing any of the following acts in the City of Bakersfield for the purpose. of securing financial gain therefrom, and who has not engaged in or conducted the business of doing any one of such acts in the City of Bakersfield for a period of ninety (90) days, Sundays and holidays excepted, if such business be customarily conducted during Sundays and holidays, next preceding the date of commencing any of the same: (a) Taking or making photographic portraits or photographic views. i (b) Selling, offering for sale, soliciting for the sale of, bargaining or battering for, exchanging, or giving away any photographs, or enlargements of photographs by any means whatsoever. (c) Soliciting for, collecting, receiving or delivering photo finishing, exposed roll films, exposed negatives, film packs, exposed cut films, or exposed glass plates. SECTION 2. (a) It shall be unlawful for any person to engage in the business of Transient Photographer or Transient Photo Finisher or to help or assist any Transient Photographer or Transient Photo Finisher in the City of Bakersfield until and unless each such person shall first deposit with the Tax and License Collector of the City of Bak- ersfield a cash or corporate surety bond in the sum of Nine Hundred ($900.00) Dollars. -1- (b) Such bond shall be conditioned that the principal thereon, the Transient Photographer, Transient Photo Finisher, or the helper or assistant of a Transient Photographer or Transient Photo Finisher, shall actually conduct the business of a Transient' Photographer or Transient Photo Finisher, or a helper or assistant of a Transient Photographer or Transient Photo Finisher, during a continuous period of not less than ninety (90) days, Sundays and holidays excepted, if such business be not customarily conducted during Sundays and holidays, f tom and after the date on which said bond is filed, and shall provide that\in the event that ~uch business is not actually conducted during all of said period, then the princi- pal and sureties on such bond shall be liable ther.z-on and shall pay to the City of Bakersfield the sum of Ten ($10.00) Dollars for every day or fraction thereof such business has been conducted by the principal and/or assistant during any part of the said period of ninety (90) days. (c) Such bond shall be approved by the City Attommey of the City of Bakersfield before the same shall be accepted by the Tax and License Collector of the City of Bakersfield. SECTION 3. (a) A Transient Photographer and Transient Photo Finisher shall not be relieved f~om the provisions of this ordinance by reason of temporarily associating with, becoming connected with, becoming a part of, or by acting in the name of any other person, finn, association or corporation. (b) Nothing contained in this ordinance shall be deemed to ~equire any person proposing to commence any business within the purview of this ordinance to deposit a bond conditioned as provided herein, when such person, or his predecessor in interest, shall have engaged in a business of the same kind as that which such person shall so propose to commence, in the City of Bakersfield or in any territory annexed to the City jf Bakersfield, for a continuous period of ninety (90) days, Sundays and holidays excepted if such business be not customarily conducted during Sundays and holidays, 'during the one hundred days next preceding the date of comenc~ng.such business. SECTION 4. The Tax and License Collector of the City of Bakersfield shall issue a certificate of compliance to each person who shall have posted a bond as herein r equi~ed. Said certificate shall c~n- tain the name and address of the person to whom issued, and shall state that such person has d eposited the bond required by this ord- inance. The certificate of compliance, which shall not be transferable, shall be endorsed by the person who is to actively engage in the business of a Transient Photographer or Transient Photo Finisher, in the City of Bakersfiel~ The person to whom such certificate of compliance shall be issued shall carx~y the same at all times he is engaged in such business in the City of Bakersfield, and he shall exhibit the same whenever requested to do so by any Police Officer of the City of Bakersfield, or by any person solicited by or with whom the holder thereof shall engage or attempt to engage in business in the City of Bakersfield. SECTION 5. Nothing contained herein Shall be deemed to apply to persons engaging in the business of taking moving pi6tures, still pictures .taken in connection with moving pictures or still pictures taken.in connection with public events. SECTION 6. Every person violating any of the provisions of this ordinance shall be deemed guilty of a misdemeanor and upon.conv~ction thereof shall be punishable by a fine of not more than Three Hundred ($300.00) Dollars or by imprisonment in the County Jail for not more than ninety (90) days, or by both such fine and imprisonment. Every such person shall be deemed guilty of a separate offense for each and every day during which any of the provisions of this ordinance ape violated.
